Article 5: Uses <br /> Section 5.6: Standards for Commercial SERVICE Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-50 <br /> <br />The actual area of the property intended for theuse as a family cemetery <br />internment of human remains shall not exceed 40,00020,000 square feet of land <br />area. <br />(2) Only members of the property owner’s family can be interred consistent with the <br />definition of Family as contained within this Ordinance. <br />(3) ProeprtyProperty owner shall be required to prepare documents outlining the <br />location of the cemetery and access and maintenance responsibilities for <br />recordation onwithin the Orange County Registrar of Deeds Office. <br /> Abandonment/discontinuation of a family cemetery shall be completed in <br />accordaince with the requirements of the North Carolina General Statutes <br />Chapter 65. <br />(C) Standards for Commercial Cemeteries <br />(A)(1) Standards for Class B Special Use Permit Shall only be permitted through the <br />submittal of a Class B Special Use Permit in accordance with Section 2.7 of this <br />Ordinance. <br />(1)(2) Submittal Requirements <br />In addition to the information required by Section 2.7, the following shall be <br />submitted as part of the application: <br />(a) Evidence that the requirements of the North Carolina General Statutes <br />Chapter 65 can be achieved and that the standards of the N.C, <br />Cemetery Commission shall be met. <br />(2)(3) Standards of Evaluation <br />(a) A minimum lot size of two acres is provided. <br />(b) The site shall have direct access to a collector or arterial street <br />(c) There shall be adequate space within the site for the parking and <br />maneuvering of funeral cartilages. <br />(d) No interments shall take place within 30 feet of any lot line.11 <br />5.6.2 Community Center 12 <br />(B)(A) Standards for Class B Special Use Permit <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following information <br />shall be supplied as part of the application for approval of this use: <br />(a) A description of the exact type of facility planned, the size of the building, <br />the number of participants; a signed statement from the owners or <br />operators that the facility will be operated by a non-profit organization. <br />(b) A site plan showing the location of the existing and proposed buildings, <br />access points, parking, service areas, and outdoor recreation areas. <br />(c) Building plans for all existing or proposed structures. <br />(d) Landscape plan, at the same scale as the site plan, showing existing or <br />proposed trees, shrubs, ground cover and any other landscape <br />materials. <br />(2) Standards of Evaluation <br /> <br />11 Requirement moved to Section 5.6.1 (A) (1) of this Ordinance. <br />12 An existing land use moved from the Miscellaneous land use category.
