We actually initiated an 379 <br />enforcement action against them and I had to rescind that enforcement action. I think because it was State. 380 <br /> 381 Inaudible 382 <br /> 383 <br />Michael Harvey: We initiated from the enforcement standpoint on the land use component but I think their argument at the 384 <br />time was we are a state entity, it was part of the college operation and therefore it was exempt, because they didn’t do 385 <br />classes. Is that your recollection? 386 <br /> 387 <br />Craig Benedict: Yeah. 388 <br /> 389 <br />Michael Harvey: So in that instance, yeah, they would be exempt. 390 <br /> 391 <br />Lydia Wegman: So they’re exempt from pollution control? 392 <br /> 393 <br />Michael Harvey: No, but they’re exempt from my land use provisions. 394 <br /> 395 <br />Tony Blake: A dear got involved. 396 <br /> 397 <br />Michael Harvey: Remember that all this is is do I have to take them through a land use permitting process. Which doesn’t 398 <br />mean they don’t have to comply, but let’s be candid, a State institution is going to be complying with State Erosion Control 399 <br />Storm water guidelines, not local. A State institution’s going to be complying with State Waste Water Permitting Processes, 400 <br />not local. So I hate to say it but you get what you get. 401 <br /> 402 <br />Craig Benedict: There’s one other in here because we had a proposal for an athletic school, like Nick Bollettieri’s tennis school 403 <br />where they actually taught class and played tennis so I don’t know where that… Maybe it’s the schools dance or maybe we 404 <br />could put schools athletic. 405 <br /> 406 <br />Michael Harvey: I wonder if it would be covered under gymnastics but we could certainly add the term athletic. 407 <br /> 408 <br />Tony Blake: So if a school had a facility that was non-educational that would fall under a different category entirely than this 409 <br />one, right? 410 <br /> 411 <br />Michael Harvey: Give me an example. 412 <br /> 413 <br />Tony Blake: The record center on 54. 414 <br /> 415 <br />Michael Harvey: Well from my standpoint I think that the oddest answer to your question is that would still be considered part 416 <br />of the UNC facility, under that umbrella. I know you’re trying to give that as an example of how… 417 <br /> 418 <br />Tony Blake: Take UNC out of it, if it was a private college would that fall under an educational category or under a… 419 <br /> 420 <br />Michael Harvey: I would say it would still fall under educational because if the primary mode of operation is the support of the 421 <br />operation of the school but it would still have to be approved through the appropriate SUP process under this construct. Now 422 <br />let’s take that to the next question. If you have a storage facility where UNC rents a couple of lockers does that mean that 423 <br />becomes a school? The answer’s no because it’s storage. But if UNC or DUKE comes to Orange County builds a warehouse 424 <br />for the storage of documentation that is an extension of Duke University it would require, as we’re reconfiguring here, a Class 425 <br />A SUP as a private institution. 426 <br /> 427 <br />Tony Blake: Ok. 428 <br /> 429 <br /> 12
