Article 7: Subdivisions <br /> Section 7.12: Flexible Developments <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 7-39 <br /> <br />(F) Diversity and originality in lot layout shall be encouraged to achieve the best possible <br />relationship between the land and the development. <br />(G) Up to one-fourth of the land with slopes greater than 15% may be removed or altered <br />only when such slopes are small and isolated and do not otherwise adversely affect the <br />design of the development. <br />(H) At least 20% of the gross land area is designated as common open space. <br />(I)(J) No more than 50% of the required common open space shall be used exclusively for <br />sewage treatment systems, utilities, or other uses which prohibit access by the residents <br />of the cluster subdivision. This restriction does not apply to areas of historic or natural <br />significance which may be protected by access restrictions. <br />7.12.6 Additional Submittal Requirements <br />In addition to the requirements outlined in Article 2 regarding Major Subdivision Preliminary <br />Plans or Minor Subdivision Final Plats, applications must be accompanied by: <br />(A) Application shall be identified as a Cluster Development Subdivision. <br />(B) A precise description of the extent to which the proposed modifications depart from the <br />standard requirements of the applicable zoning district and the reasons for such <br />departures. <br />(C) The location, type and area of the common open space and the adequacy of the amount <br />and function of the open space in terms of densities and dwelling types proposed. <br />(D) Written site analysis accompanies by an illustrative site map, which identifies the <br />following: <br />(1) Slopes 7½ - 15%, <br />(2) Slopes 15% and greater, <br />(3) Existing vegetation, <br />(4) Significant stands of trees, <br />(5) Significant examples of a particular species of tree occurring in a native stand <br />and specimen trees, <br />(6) Drainage and waterways, <br />(7) Special flood hazard areas, <br />(8) Significant rock outcroppings, <br />(9) Significant scenic vistas, <br />(10) Soils with limitations for on-site wastewater systems and building development, <br />(11) The manner in which the plan makes adequate provision for water and <br />wastewater treatment, and <br />(12) The relationship of the plan to the physical environment, the neighborhood in <br />which it is proposed to be established and the intent of the provisions providing <br />for the establishment of a cluster subdivision. <br />Section 7.13:SECTION 7.12: FLEXIBLE DEVELOPMENTS <br />7.13.17.12.1 Purpose <br />(A) The purpose of Flexible Development is to preserve agricultural and forestry lands, <br />natural and cultural features, environmentally sensitive areas, and areas with potential for <br />maintaining the rural community character of the rural community that might otherwise be <br />lost through or marginalized with a conventional development approaches. <br /> 190
