Article 7: Subdivisions <br /> Section 7.7: Lots <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 7-11 <br /> <br />(B) Upon recommendation of the Planning Board and approval of the County <br />Commissioners, the construction of the access road may be postponed until building or <br />market development is undertaken. <br />(1) In this case the lots shall be designated on the plat: "This lot may not be sold, <br />nor a building permit issued, until the access road has been built as specified for <br />this subdivision." <br />(C) Except where reverse frontage is desirable, double frontage lots should be avoided. <br />7.7.4 Flag Lots <br />(A) Intent <br />Orange County discourages and restricts forming flag lots. A flag lot shall be permitted if <br />necessary to allow a property owner reasonable use and benefit from his/her land or to <br />alleviate situations which would otherwise cause extreme hardship for him/her. <br />(B) Lot Standards <br />Flag lots are allowed only: <br />(1) Where necessary to eliminate access onto arterials (See Fig. 7.7.4.B, Diagram <br />1); <br />(2) To reasonably utilize irregularly shaped land (See Fig. 7.7.4.B, Diagram 2); <br />(3) To reasonably utilize land with difficult topography (See Fig. 7.7.4.B, Diagram 3); <br />and <br />(4) To reasonably utilize land with limited sites suitable for septic tank nitrification <br />fields (See Fig. 7.7.4.B, Diagram 4); <br /> <br />Figure 7.7.4.B: Flag Lots <br /> <br /> <br />(5) Where it is unlikely that a road created in lieu of a flag lot would ever be <br />extended, or otherwise needed to provide access to adjoining parcels; or, <br />(6) To provide for the protection of significant natural or cultural resources, and. <br />(7) To provide access and/or street frontage for Common Open Space areas. <br /> 176
