Article 4: Overlay Zoning Districts <br /> Section 4.2: Watershed Protection <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 4-11 <br /> <br />4.2.9 Water Supply / Sewage Disposal Facilities <br />TABLE 4.2.9: WATER SUPPLY/SEWAGE DISPOSAL FACILITIES 15 <br />DISTRICT WATER SUPPLY/SEWAGE DISPOSAL <br />UNIV-CA <br />UNIV-PW <br />Water supply and sewage treatment systems shall be limited to individual wells and on-site <br />septic tanks systems, or individual on-site alternative disposal systems. No off-site system <br />shall be permitted. <br /> <br />All Other Watershed <br />Overly Districts <br />No new treatment system will be permitted where effluent disposal occurs on a separate lot <br />from the source of wastewater generation; provided, however, off-site systems shall be <br />permitted in all Watershed Overlay Districts except the University Lake Protected <br />Watershed (UNIV-PW) and Critical Area (UNIV-CA) when located in a Flexible Development <br />subdivision approved in accordance with Section 7.13 of this Ordinance. <br /> <br />Off-site individual septic systems associated with a Flexible Development Option <br />Subdivision as outlined in UDO Section 7.12 must be contained within Common Open <br />Space and approved by Orange County Environmental Health Department.16 <br /> <br />UNIV-CA <br />New septic tanks and their nitrification fields shall be located outside of any stream buffers, <br />or 300 feet from a reservoir or perennial or intermittent stream as shown on the USGS <br />Quadrangle maps, whichever is further <br />CANE-CA <br />U-ENO-CA <br />New septic tanks, pump tanks and their appurtenances shall be located outside of any <br />stream buffers and at least 100 feet from a perennial or intermittent stream as shown on the <br />USGS Quadrangle maps, and at least 150 feet from a reservoir. <br />New nitrification fields shall be located outside of any stream buffers and at least 100 feet <br />from a perennial or intermittent stream as shown on the USGS Quadrangle maps, and at <br />least 300 feet from a reservoir. <br /> <br />CANE-PW <br />CANE-CA <br />U-ENO-CA <br />Water supply and sewage treatment systems shall be limited to individual wells and septic <br />tanks or individual on-site alternative disposal systems; provided however, off-site systems <br />shall be permitted when located in a Flexible Development subdivision approved in <br />accordance with Section 7.13 of this Ordinance. <br /> <br />UNIV-PW <br />CANE-PW <br />U-ENO-PW <br />HYCO-PW <br />LITTLE-PW <br />BACK-PW <br />HAW-PW <br />JORDAN-PW <br />L-ENO-PW <br />FLAT-PW <br />New septic tanks and their nitrification fields shall be located outside of any stream buffers <br />and at least 100 feet from a perennial or intermittent stream as shown on the USGS <br />Quadrangle maps. <br /> <br /> <br />15 There will need to be a comprehensive re‐assessment of these provisions in light of new septic/well <br />development standards initiated by the State. For the time being staff is recommending basic modification to <br />ensure clarity as well as the promotion of the new Flexible Development options as detailed in this amendment <br />package. <br />16 In consultation with both the County Attorney’s office and Environmental Health it was decided existing <br />language is no longer applicable given recent changes in State law. Existing language could also have been <br />interpreted as pre‐empting Environmental Health’s permit authority, which it cannot do. <br /> 163
