Article 2: Procedures <br /> Section 2.14: Minor Subdivisions <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 2-46 <br /> <br />(d) A copy of the Final Plat indicating approval of the plan to control <br />sedimentation and erosion during construction of improvements. <br />Where an erosion control plan is required, it shall comply with the <br />provisions of Section 6.15 of this Ordinance. If an erosion control plan <br />is not required, the copy of the Final Plat must be signed by the <br />Erosion Control Officer certifying that a plan waiver has been approved <br />or the amount of land disturbance on the site is not subject to the <br />provisions of Section 6.15 of this Ordinance; and <br />(e) A statement describing the methods proposed to protect environmental <br />resources identified in "An Inventory of Sites of Cultural, Historic, <br />Recreational, Biological and Geological Significance in the <br />Unincorporated Portions of Orange County" and/or "Inventory of the <br />Natural Areas and Wildlife Habitats of Orange County, North Carolina". <br />(B) Review and Action <br />(1) The Planning Director shall determine if the plat and application conform with all <br />applicable regulations. <br />(2) Auxiliary documents required by Article 7 shall be submitted by the Planning <br />Director to the County Attorney for review and recommendation. <br />(3) The Planning Director may submit copies of the Final Plat application and <br />accompanying material to other officials and agencies for review and comment. <br />Other potential reviewers include, but are not limited to: <br />(a) NC DOT, <br />(b) Orange County Schools, <br />(c) Orange County Land Records, <br />(d) County Attorney, <br />(e) Orange County Environmental Health, <br />(f) Orange County Erosion Control, <br />(g) Orange County Engineering, <br />(h) Public Utility Companies, and <br />(h)(i) Orange County Department of Environment, Agriculture, Parks and <br />Recreation (DEAPR).2 <br />(4) Reviewers shall provide a certification to the Planning Director of the suitability, <br />provisional suitability, or unsuitability of the proposal. Recommendations of the <br />reviewers may be incorporated as conditions of approval of the subdivision. <br />(5) The Planning Director shall take action on an application solely on his/her <br />findings as to compliance with applicable regulations and conditions and shall <br />either: <br />(a) Approve the application; or <br />(b) Approve the application with conditions; or <br />(c) Deny the application. <br />(6) The Planning Director shall notify the applicant of the action in writing. <br />(C) Action Subsequent to Approval <br /> <br />2 Although part of the Development Advisory Committee (DAC) meeting process, staff is modifying this list to  <br />include DEAPR so that we receive their comment(s) on any final plat application.  <br /> 138
