NAICS Code <br /> <br />PURPOSE: To review revisions incorporated in response to comments made at the September <br />12 quarterly public hearing and to make a recommendation to the BOCC on government- <br />initiated amendments to the text of the UDO that would modify some development standards, <br />types of permitted uses, and use standards within the Hillsborough Economic Development <br />District (EDD). <br /> <br />BACKGROUND: In response to comments made at the September 12 quarterly public hearing, <br />staff has modified the proposed text amendments pertaining to the EDH zoning districts. The <br />comments pertained to: <br />• A suggestion that drive through facilities be allowed in all EDH zoning districts. A current <br />Development Standard in the Article 3 charts prohibited such facilities in each of the EDH <br />district. This prohibition is proposed for deletion. <br />• Removal of certain Manufacturing uses that are listed in the NAICS Code but not desired <br />as permitted uses in the Hillsborough Economic Development District. In consultation <br />with the Attorney’s office, staff has achieved this revision by undertaking a more <br />comprehensive amendment to the Permitted Use Tables in Section 5.2 of the UDO. The <br />proposed amendments now include revisions to the tables for General Use and <br />Conditional Zoning Districts because the way in which Manufacturing uses are listed <br />should be consistent among the various tables. <br />o As a reminder, staff is currently working on a comprehensive overhaul to all of the <br />Tables of Permitted Uses in order to bring the UDO into better compliance with a <br />judicial decision (Byrd v. Franklin County). Therefore, the current proposed <br />amendments, if adopted, may undergo further amendments as part of the <br />comprehensive effort. <br /> <br />The BOCC deferred action on the text amendments (and the related rezoning) until the <br />November 1, 2016 BOCC meeting to give staff time to incorporate revisions and time for the <br />Planning Board to review the revisions. The Planning Board previously considered these <br />amendments at its August 3 and September 7 meetings. Materials for these meeting are <br /> 10
