Article 6: Development Standards <br /> Section 6.7: Additional Standards for MPD-CZD <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 6-42 <br /> <br />(C) Development Standards <br />(1) Dimensional Requirements <br />(a) There are no minimum lot sizes within the MPD-CZ district; However, the <br />Master Plan will set forth the individual lot setbacks in accordance with <br />the General Dimensional Requirements established herein. <br />TABLE 6.7.5.C: SPECIFIC STANDARDS FOR HILLSBOROUGH EDD <br />ZONING <br />DISTRICT <br />MINIMUM ZONING <br />LOT MINIMUM SETBACKS <br />MAXIMUM <br />IMPERVIOUS <br />SURFACE <br />COVER (%) <br />MAXIMUM <br />HEIGHT <br />(FEET) AREA <br />(ACRE) <br />WIDTH <br />(FEET) <br />FRONT <br />(FEET) <br />REAR <br />(FEET) <br />SIDE <br />ONE <br />SIDE <br />(FEET) <br />COMBINED <br />(FEET) <br />STREET <br />(FEET) <br />MPD-CZ - 200 60 40 20 40 40 50 60 <br />(b) Single-family and duplex residential uses following the flexible <br />development guidelines established in Section 7.13 of this Ordinance, <br />may reduce the minimum setbacks by 50% and the lot width by 60%. <br />(2) Internal Access <br />(a) All outparcels within the MPD-CZ district shall have internal access to the <br />development. <br />(b) All parcels shall provide for interconnectivity between parking areas if <br />determined necessary by staff. <br />(3) No drive through facilities may be constructed in this district. <br />(4) Consideration of lower cost and affordable housing shall be incorporated into any <br />mixed use development. <br />(5) A justification for any deviation to development standards must state a public <br />benefit or purpose. <br />(D) Plan Approvals <br />(1) If a MPD-CZ rezoning application is approved with a Master Plan, the approval <br />does not obviate the need to obtain a Class A Special Use Permit or site plan <br />approval for the individual “pods”/lots shown on the Master Plan in accordance <br />with the provisions of this Ordinance. <br />(2) Tracts over 2.0 acres and/or structure(s) totaling cumulatively over 20,000 <br />square feet on one zoning lot require a Class A Special Use Permit approved in <br />accordance with the provisions of this Ordinance. Otherwise, the site plan may <br />be approved in accordance with Section 2.5 of this Ordinance. A Class A <br />Special Use Permit shall be required if any nonresidential use is located within <br />two hundred feet of a property line of an existing dwelling unit located on a lot <br />smaller than 2 acres in size. See Section 5.3.2(C) for standards for uses <br />requiring a Class A Special Use Permit.39 <br /> <br />39 In order to promote economic development opportunities in the Hillsborough EDD, Staff is suggesting deletion <br />of language that requires a Class A Special Use Permit for projects above a certain size. However, in keeping with <br />how the EDH general use zoning districts operate, staff is suggesting that a MPD-CZ project within the Hillsborough <br />EDD be required to obtain a Class A Special Use Permit if any nonresidential use located within 200-feet of existing <br />dwellings on smaller sized lots. <br /> 55
