Article 5: Uses <br /> Section 5.6: Standards for Commercial Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-50 <br /> <br />(c) Multi-family dwellings shall not exceed 25% of the total square footage of <br />all structures on the site.31 <br />SECTION 5.6: STANDARDS FOR COMMERCIAL USES <br />5.6.1 Nightclubs, Bars and Pubs <br />(A) General Standards for Evaluation <br />(1) Buildings for nightclubs, bars and pubs shall not be located within 200 feet of a <br />residence. <br />5.6.2 Massage Business <br />(A) General Standards for Evaluation <br />(1) Must comply with the Ordinance for the Control of Massage and Massage <br />Establishments <br />(2) The submittal of construction plans for all existing and proposed buildings <br />housing the massage business. The construction plans shall include floor plans <br />and cross sections showing the proposed use of all portions of such buildings. <br />(3) For existing buildings, certification by the Orange County Building Inspector that <br />the structure(s) complies with the North Carolina Building Code and all related <br />construction codes. <br />5.6.3 Garden Center <br />(A) General Standards for Evaluation <br />(1) Outdoor display and storage of goods will be permitted. <br />(2) Outdoor storage of bulk goods shall be located to the rear or side of the primary <br />building and screened on three sides by an eight foot high opaque wall or fence. <br />(3) Outdoor storage for bulk goods shall be limited to 1,500 square feet per acre of <br />the zoning lot. <br />5.6.4 Junkyards <br />(A) Standards for Class A Special Use Permit <br />(1) Submittal Requirements – <br />In addition to the information required by Section 2.7, the following information <br />shall be supplied as part of the application for approval of this use: <br />(a) Detailed plans and specifications for the site screening proposed. <br />(b) Description of type and number of motorized machines to be employed <br />upon site. <br />(c) Indicate on the site plan the extent of area to be used for the storage of <br />junked or wrecked motor vehicles <br />(2) Standards for Evaluation - <br />(a) The site shall be screened from adjacent property by a minimum of an <br />eight foot high solid fence or equal, uninterrupted except for required <br />vehicle access points. <br /> <br />31 Attorney’s office staff has suggested the replacement language in (a), (b), and (c). It accomplishes the same <br />intent as the previously proposed language. <br /> 51
