<br /> <br /> <br /> <br />REQUIREMENT UDO SUPPORTING EVIDENCE Staff BOA <br />SPECIFIC STANDARDS <br />In accordance with Section 5.3.2 (A) (2), the Board of Adjustment shall also consider the following general <br />conditions before the application for a Special Use can be approved. <br /> <br /> <br />The use (will / will not) maintain or <br />promote the public health, safety and <br />general welfare, if located where <br />proposed and developed and <br />operated according to the plan as <br />submitted. <br /> <br /> <br />Section 5.3.2 <br />(A) (2) (a) <br /> <br />Application package as contained <br />in Attachment 2 inclusive including, <br />but not limited to: <br /> Narrative <br /> Environmental Assessment <br />(EA) Application <br /> Site Plan <br /> <br />Site Assessment (Attachment 1) <br />Staff review comments <br />(Attachment 4) <br /> <br />Based on all above findings, <br />Applicant’s Narrative, and Staff’s <br />report, the Board finds the use will <br />maintain or promote the public <br />health, safety, and general welfare <br />if located where proposed and <br />developed and operated according <br />to the plan as submitted. <br /> <br /> <br />Yes <br />The use (will / will not) maintain or <br />enhance the value of contiguous <br />property (unless the use is a public <br />necessity, in which case the use <br />need not maintain or enhance the <br />value of contiguous property). <br /> <br />Section 5.3.2 <br />(A) (2) (b) <br /> <br />Application package as contained <br />in Attachment 2 inclusive including, <br />but not limited to: <br />- Narrative; <br />- Staff abstract, <br />- Review comments <br />(Attachment 4); and <br />- Letter from Mrs. Rose <br />Finely, Commercial Realtor <br /> (Attachment 4). <br /> <br />Based on all above findings, and a <br />lack of competent/material <br />evidence in the record refuting the <br />testimony, the Board finds the use <br />will maintain or enhance the value <br />of contiguous property. <br /> <br />Yes <br /> <br /> <br /> <br /> <br />50 of 200
