Article 6: Development Standards <br /> Section 6.4: Performance Standards <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 6-9 <br /> <br />6.3.5 Recreation Space <br />(A) The minimum recreation space required shall not be less than the number of square feet <br />derived by multiplying gross residential land area by the recreation space ratio (RSR) <br />applying to the zoning district, as established in Article 3 of this Ordinance. <br />6.3.6 Pedestrian / Landscape Space <br />(A) The minimum pedestrian / landscape space shall not be less than the number of square <br />feet derived by multiplying gross land area by the pedestrian/landscape ratio (PLR) <br />applying to that zoning district, as established in Article 3 of this Ordinance. <br /> <br />SECTION 6.4: PERFORMANCE STANDARDS <br />6.4.1 Applicability <br />(A) After the effective date of this Ordinance, any use established or changed to, and any <br />building structure, or land developed, constructed or used for, any permitted principal <br />use, special use, or conditional use, shall comply with all of the performance standards <br />herein set forth for the district involved. <br />(B) The performance standards contained herein shall apply in commercial, industrial, <br />economic development, and conditional districts. <br />(C) If any existing use or building or other structure is extended, enlarged, or reconstructed, <br />the performance standards for the district involved shall apply with respect to such <br />extended, enlarged, or reconstructed portion or portions of such use, building, or other <br />structure. <br />(D) Within 24 months of the effective date of this Ordinance, all presently existing uses of <br />lands, buildings or other structures shall comply with the performance standards as <br />herein set forth for the district subject to performance standards. <br />6.4.2 Electrical Disturbance or Interference <br />(A) Commercial, Industrial, and Conditional Zoning Districts <br />No Permitted Use, Special Use, Conditional Use, or Accessory Use, or Secondary Use <br />shall: <br />(1) Create any electrical disturbance that adversely affects any operations or <br />equipment other than those of the creator of such disturbance; or <br />(2) Otherwise cause, create, or contribute to the interference with electronic signals <br />(including television, and radio broadcasting transmissions) to the extent that the <br />operation of any equipment not owned by the creator of such disturbance is <br />adversely affected. <br />(B) Economic Development Zoning Districts <br />(1) No use, activity or process shall be conducted which produces electric and/or <br />magnetic fields which adversely affect public health, safety, and general welfare <br />or interferes with the operation, equipment, or radio, television and/or telephone <br />reception, beyond the boundaries of the lot on which the activity is conducted. <br />(2) All establishments conducting uses, activities or processes which generate <br />electric and/or magnetic fields are expected to comply with applicable Federal <br />Communications Commission (FCC) regulations. Copies of all required FCC <br />permits, including any conditions for reporting and monitoring, must be submitted <br />with the comprehensive site development plan. <br />(3) In the Hillsborough Economic Development District, residential development shall <br />be discouraged near high voltage transmission lines. <br /> 75
