Article 6: Development Standards <br /> Section 6.12: Signs <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 6-83 <br /> <br />(B) Signs, except for off-premises signs allowed under this Section, advertising an activity, <br />business, product or service no longer conducted on the premises upon which the sign is <br />located. Such signage shall be removed within 90 days from the date of termination of <br />such activity. Upon failure of the owner to remove such signs within the prescribed time, <br />the Planning Director shall take appropriate legal action to have such sign removed;11 <br />(C) Flashing, blinking, pulsating, signs or signs with moving parts except for signs showing <br />time of day and temperature that are part of an approved sign advertising a permitted <br />business activity on a parcel of property;12 <br />(D) Signs with electronic moveable copy, scrolling messages, or other similar electronic <br />displays designed to chage display more than once an hour or a maximum of 8 times in a <br />24 hour period;13 <br />(E) Signs, other than traffic, governmental, street name signs, political signs erected in <br />accordance with State law, or other official governmental or public agency signs, shall not <br />be permitted within any street private street right-of-way;14 <br />(F) Roof signs; <br />(G) Snipe signs;12 <br />(H)(G) Beacon lights, animated signs, and trailer signs and snipe signs;12 <br />(I)(H) Portable signs, unless approved for a special event in accordance with Section <br />6.12.11(D)13(C);15 <br />(J)(I) Signs supported in whole or in part by water, gas, air, or could otherwise be designated <br />as inflatable signs; Individuals erecting an inflatable sign shall be subject to an immediate <br />notice of violation and shall be required to remove the sign within the time frame it would <br />normally take to deflate the sign, unless approved for a special event in accordance with <br />Section 6.12.11(D)13 (C);15 <br />(K)(J) Signs mounted on a single pole or mast; <br />(L) Signs that contain rotating sign panels or objects;16 <br />(M)(K) Signs that obstruct ingress and egress to any door, window, fire escape, stairway, ladder, <br />or other opening intended to provide light, air, ingress, or egress for any room or building; <br />and <br />(N)(L) Signs that violate any provision of any law of the State of North Carolina relative to <br />outdoor advertising. <br />(O)(M) Signs erected on telecommunication facilities or support structures other than those <br />required by local, State, or Federal law.17 <br /> <br />11 Language within the highlighted section is still being evaluated.  <br />12 In consultation with the County Attorney we are eliminating language that could be construed as establishing  <br />prohibitions or allowances based on a signs content.  <br />13 Staff is proposing a universal standard for what constitutes electronic changeable copy to ensure proper  <br />enforcement.  In reviewing the standard with the Attorney’s office there does not appear to be concern over  <br />establishing limits on the number of times in a given day the display can change.   <br />14 As we have no authority to regulate signage within NC DOT rights‐of‐ways we are amending the language within  <br />this section accordingly.  <br />15 Regulations  governing special event displays has been moved.  This is the new section reference.  <br />16 Staff is recommending this provision be deleted as it is redundant given the wording of Section 6.12.6 (C).  <br />17 From time to time staff receives requests to allow signage on telecommunication facilities.  To date we have  <br />forbidden such placement.  We are including language within the UDO formalizing this prohibition.  <br /> 26 26
