Article 5: Uses <br /> Section 5.4: Standards for Temporary Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-34 <br /> <br />(c) The proposed activity will occur no more frequently than seven days in a <br />30-day period, and on no more than 50 days per year. <br />(d) Signs shall be permitted in accordance with Section 6.12.11(D) of this <br />Ordinance. <br />(e) All parking shall be on-site. <br />(f) Noise levels at the boundary of the area included in the special Use <br />Permit shall not exceed 50 decibels between the hours of 7:00 a.m. and <br />7:00 p.m., or 45 decibels between the hours of 7:00 p.m. and midnight. <br />No Special Event shall begin before 7:00 a.m., or extend beyond <br />midnight. <br />(g) The site plan shall have the written approval of the Orange County <br />Division of Environmental Health regarding the adequacy of the water <br />supply and wastewater disposal for the specified maximum number of <br />participants for any single event and the written approval of the Orange <br />County Fire Marshal and Orange County Sheriff’s Department regarding <br />the adequacy of parking, access or other factors relating to public safety. <br />(h) The Special Use Permit shall be valid for no more than one year. <br />5.4.4 Temporary Use of a Residential Mobile Home <br />(A) General Standards of Evaluation <br />Residential Mobile Homes may be permitted as a temporary use during construction in <br />accordance with the following: <br />(1) The property owner shall reside in the temporary residential mobile home during <br />construction of a new residence or the renovation of an existing residence on the <br />same lot. <br />(2) Prior to placement of the temporary residential mobile home on-site all applicable <br />state and local approvals and permits shall be procured, including but not limited <br />to a zoning compliance permit, building permits, and health department approval. <br />(3) The temporary residential mobile home must be removed within 90 days of <br />receipt of the certificate of occupancy for the on-site residence. <br />(B) Standards for Class B Special Use Permit 1 <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following information <br />shall be supplied as part of the application for approval of this use: <br />(a) One of the following types of relationships shall exist between the <br />occupants of mobile home and the existing single family dwelling. <br />(i) Blood relationship. <br />(ii) Relationship by marriage. <br />(iii) Legal guardian relationship designated by Court of Law. <br />(b) A certificate in writing, from a licensed physician (MD) stating the <br />necessity of direct custodial care because of age or poor health. <br />(c) Floor plan of the existing single family unit showing that there is no <br />reasonable alternative based on the utilization of the existing floor plan. <br /> <br />1 Based on the proposed amendment, Section 5.4.4(B) will be modified and moved to Section 5.5.9. <br /> 43
