5 <br /> <br />unit. The maximum of five people is based on the 2012 North Carolina <br />Residential Code. Once there are more than five unrelated people residing <br />together the dwelling unit must be classified and reviewed under the 2012 <br />North Carolina State Building Code as a rooming or boarding house. A <br />rooming or boarding house is reviewed and permitted differently in the North <br />Carolina State Building Code and UDO compared to a single family dwelling <br />unit. <br /> <br /> BOCC Member Comment: Concern with the requirement that the occupant of <br />the temporary health care structure must be a North Carolina resident. As a <br />result of this requirement, an Orange County resident would not be able to <br />care for an elderly parent or sick relative from out of state. <br />Staff Response: The proposed amendment will address this comment by <br />removing the standard requiring the mentally or physically impaired individual <br />be a North Carolina resident. <br /> <br /> BOCC Member Comment: Recommendation that staff provides information <br />regarding Session Law 2014-94 on the county website for the public to access. <br />Staff Response: A link to Session Law 2014-94 has been added to the Orange <br />County Planning and Inspections webpage. <br /> <br /> BOCC Member Comment: As the county moves forward with modifications to <br />the proposed amendment it is recommended that staff solicit comments from <br />the Towns of Chapel Hill, Carrboro, and Hillsborough. <br />Staff Response: The proposed amendment was provided to the Towns of <br />Chapel Hill, Carrboro, and Hillsborough for review and comment on December <br />22, 2015. <br />d. Other <br /> <br />2. PUBLIC INVOLVEMENT PROGRAM <br />Mission/Scope: Public Hearing process consistent with NC State Statutes and <br />Orange County ordinance requirements. <br /> a. Planning Board Review: <br />December 3, 2014 – Ordinance Review Committee <br />This item was presented at the December 3, 2014 Ordinance Review Committee <br />meeting for Planning Board review and comment.
