BOCC Updates/Checkpoints <br />May 5, 2015 – Approval of UDO Amendment Outline Form <br />September 2, 2015 – Planning Board Ordinance Review Committee (ORC) <br />November 23, 2015 – Quarterly Public Hearing <br />This item was reviewed at the November 23, 2015 Quarterly Public Hearing <br />where the following comments were made: <br />• A BOCC member asked why the exposure of the male breast was not <br />included within the definition of nudity proposed for Article 10 of the UDO. <br />There was concern we are assisting in perpetuating a stereotype holding <br />exposure of the male and female breast should be treated differently. <br />STAFF COMMENT: The proposed definition was taken from other <br />similar ordinances that had survived legal challenges and staff did not <br />want to make significant changes as a result. <br />Exposure of the male breast is not typically viewed from either a <br />societal or legal perspective as being inappropriate. However, staff will <br />work with the Attorney’s office on revising the proposed definition of <br />nudity to address the concern. <br />• A BOCC member asked if the text amendment would create a land use <br />regulation for nudity. There was a concern the definition could have <br />unintended consequences, specifically on people engaging in swimming <br />activities at private clubs or public pools. <br />STAFF COMMENT: The proposed definition of Nudity or a State of <br />Nudity provides clarification and context to other recommended <br /> 47
