Proposed UDO Text Amendment(s) <br /> INFORMATION CONTACT: <br /> Michael Harvey, Planner III (919) 245-2597 <br /> Craig Benedict, Director (919) 245-2585 <br /> <br />PURPOSE: To continue review of, and make a recommendation to the BOCC on, Planning <br />Director initiated amendments to the Unified Development Ordinance (UDO) regarding <br />recreational land uses. <br /> <br />BACKGROUND: This item was presented at the September 8, 2015 Quarterly Public Hearing <br />(materials available at: http://www.orangecountync.gov/document_center/BOCCAgendaMinutes/150908.pdf ). <br />For background information on the proposal please refer to Section B.1 of Attachment 1. <br /> <br />The review of this item began at the October 7, 2015 Planning Board meeting (materials <br />available at: http://www.orangecountync.gov/Full_Agenda_Packet___PB_10_7_15.pdf) and <br />continued at the November 4, 2015 meeting (materials available at: <br />http://www.orangecountync.gov/PB_Full_Agenda_Package_110415.pdf). <br /> <br />During the November 4 meeting the Board was informed the County Attorney had concerns <br />over Planning staff enforcing proposed setback and backstop standards for private shooting <br />ranges, specifically over our safety in engaging in an inspection/enforcement action. The <br />Attorney indicated he believed it would be more prudent to see these standards located within <br />the County’s general ordinances and enforced by a law enforcement agency (i.e. the Sheriff’s <br />office). <br /> <br />The Board requested additional information on the possible modification of the text amendment <br />indicating they believed proposed setback/backstop construction standards were necessary. <br />The Board also requested an opportunity to review and comment on the Attorney’s proposal. <br /> <br />In reviewing the matter with the County Attorney, staff was informed a final determination had <br />not been made and that the BOCC would be asked to provide direction. Staff will reiterate the <br />Attorney is not objecting to the adoption of setback/backstop construction standards, but is <br /> 16
