<br />b. The BOCC appoints both the ETJ representative and the Transition Area <br />representative to the Town’s two advisory boards. <br />2. In October 2014, the Town extended its Extraterritorial Jurisdiction (ETJ) over the Rogers <br />Road area (in the northwest portion of the town on the map included in Attachment 1). <br />This action left the Town with 274 acres of Joint Planning Transition Area. The Town <br />estimates there is a population of approximately 297 persons within the remaining <br />Transition Area (includes children and adults). <br />3. The Town has two primary concerns regarding the existing language of the Joint <br />Planning Agreement: <br />a. The relative representation on the advisory boards of ETJ (required by Statute) <br />and Transition Area residents significantly exceeds the overall membership <br />number of the boards when compared to the entire population of Chapel Hill. For <br />example, on the Planning Commission two of the nine seats (22%) would be <br />occupied by persons representing only 6.7% of the total population in the Town’s <br />jurisdiction. <br />b. Recruiting willing adult volunteers from the remaining Transition Area to serve on <br />the two advisory boards could prove difficult and seats could remain vacant for <br />extended periods of time. <br />4. Two options were submitted by the Town for consideration: <br />a. (Option A) This option, recommended by the Town’s Planning Commission, would <br />replace the Transition Area seat with a Town of Chapel Hill resident. The ETJ <br />seat would remain since it is required by Statutes but it could be designated to <br />represent both the ETJ and Transition Area (although the representative would <br />have to reside in the ETJ in order to be in compliance with Statutes). <br />b. (Option B) This option would replace the Transition Area seat with either an ETJ <br />or Transition Area resident who would represent both types of areas. The BOCC <br />would have 90 days to appoint a representative, after which the seat could be <br />filled by the Town Council with a Chapel Hill resident. The BOCC would have the <br />opportunity to request more time to fill a vacancy if an appointment could not be <br />made within 90 days. This seat would be in addition to the statutorily required ETJ <br />seat. <br /> <br />Planning Director’s Recommendation: The Planning Director recommends that Option B be <br />recommended to the BOCC as it is the better option for potentially having a Transition Area <br />representative on the Town’s advisory boards while implementing a reasonable solution should <br />recruiting a volunteer prove difficult. <br /> <br />RECOMMENDATION(S): The Planning Staff recommends the Planning Board: <br />1. Discuss the proposed amendments to the Joint Planning Agreement as desired. <br />2. Make a recommendation to the BOCC in time for the December 7, 2015 BOCC <br />meeting. <br /> 42
