PUBLIC INVOLVEMENT PROGRAM <br />Mission/Scope: Public Hearing process consistent with NC State Statutes and <br />Orange County ordinance requirements <br /> <br />a. Planning Board Review: <br />July 1, 2015 – Ordinance Review Committee (ORC). The ORC reviewed this <br />item at its July 1, 2015 meeting where the following comments/questions were <br />made: <br />• Could a resident, on his own property, sponsor a club in his name and <br />finance play on the field under this proposal? <br />STAFF COMMENT: As the Ordinance is currently written, and proposed, <br />the property owner would have to get a special use permit as the <br />proposed recreational land use is intended to serve the needs of the <br />general public or members of a club/organization. <br />• Could I develop a putting green on my property? <br />STAFF COMMENT: You can have a recreational facility on your property <br />and use it for recreational purposes, including a putting green. <br />When a recreational amenity is opened up for public use/access, however, <br />the nature of the use of property changes and becomes more than a <br />simple accessory use. Staff argues it becomes a recreational facility used <br />to satisfy the needs of the general public, which requires a heightened <br />level of permit review to operate. <br />• Could a farmer donate land to a non-profit organization to allow for the <br />development of a recreational facility? <br />STAFF COMMENT: Yes but they would have to obtain a Class B Special <br />Use Permit for the use. This is the current requirement and we are not <br />recommending a change to the existing process. <br />• Is the intent with this regulation to control the development of gun ranges <br />specifically? <br />STAFF COMMENT: The amendment seeks to make it easier to identify <br /> 21
