construction of the Dwelling Unit or as approved by the Land Use and Design Review Committee. If such <br />improvements are made to the Common Areas, then such improvements must be maintained by the <br />Owner of the Dwelling Unit benefitted in a manner acceptable to the Community Association. In the <br />event the Owner shall fail to maintain such improvements in a manner acceptable to the Community <br />Association, the Community Association shall have the right and duty, after Notice and Hearing, to <br />remove the improvement and restore the Common Areas to a condition compatible with the remainder <br />of the Common Areas. <br /> <br />Maintenance of the Yards and Dwelling Units. To provide and maintain exterior harmony for all of the <br />Dwelling Units located within The Property, the Community Association shall maintain and repair the <br />exterior of the Dwelling Unit located within The Property to include but not be limited to the painting, <br />repairing, replacing and maintaining of roofs, gutters, down spouts, exterior building surfaces, patios, <br />decks and perimeter fence. Such maintenance shall not include the maintenance, repair or replacement <br />of glass in doors or windows or screened surfaces, entry door or door frames or hardware, all of which <br />shall be the sole responsibility of the Dwelling Unit's Owner. <br /> <br />The maintenance obligation on the part of the Community Association shall apply to such maintenance <br />required by ordinary wear and tear and shall not apply to maintenance, repair or restoration resulting <br />from willful neglect or destruction. <br /> <br />All other Dwelling Unit maintenance and repair shall be the sole responsibility and at the sole expense of <br />the Owner. Each Owner shall be responsible for maintaining the landscaping upon the Yard surrounding <br />his or her own Dwelling Unit. All landscaping and maintenance thereof must comply with the Rules, <br />Regulations and Guidelines established by the Land Use Committee and be in compliance the approved <br />landscape plan. <br /> <br />An Owner may elect to turn over maintenance of landscaping on the Yard surrounding his or her <br />Dwelling Unit to the Association. A written agreement and payment of an additional maintenance fee <br />are required. <br /> <br />Maintenance of Drainage Pattern. There shall be no interference with the established drainage pattern <br />initially established by the Declarant over any of the Yards and Common Areas within the Property, <br />except as approved in writing by the Land Use Committee. Approval shall not be granted unless <br />provision is made for adequate alternate drainage. The established drainage pattern shall mean the <br />drainage pattern which exists at the time the overall grading of any property is completed by the <br />Declarant and shall include any established drainage pattern shown on the plans approved by the Land <br />use Committee. The established drainage pattern may include the drainage pattern from the Common <br />Areas over any Yards with The Property and from any Yard within The Property over the common Areas, <br />or from any Yard over another Yard. <br />22
