Draft Ordinance Approving Rezoning with <br />Development Conditions <br /> <br /> <br />PURPOSE: To continue review and make a recommendation to the BOCC on a request to <br />rezone a 112 acre parcel of property to Master Plan Development – Conditional Zoning (MPD- <br />CZ) district in accordance with the provisions of Section 2.9.2 of the Unified Development <br />Ordinance (hereafter ‘UDO’). <br /> <br />Conditional Zoning District (CZD) Process: The process involves the approval of a rezoning <br />petition and site plan allowing for the development of specific land use(s) on a parcel of <br />property. Applications are processed in a legislative manner (i.e. does not require sworn <br />testimony or evidence) and decisions are based on the BOCC’s determination that the project is <br />consistent with the purpose and intent of the Comprehensive Plan. The typical cadence for the <br />review of a CZD application is: <br />• First Action – Planning staff schedules a Neighborhood Information Meeting (NIM). <br /> Staff Comment – DONE. This meeting was held on April 8, 2015. <br />• Second Action – The BOCC and Planning Board review the application at 1 of 4 <br />joint Quarterly Public Hearings. <br /> Staff Comment – DONE. The public hearing was held on May 26, 2015. <br />• Third Action – The Planning Board makes a recommendation on the proposal. <br /> Staff Comment – The Planning Board began their review of this item at its July <br />1, 2015 regular meeting and will continue review at its September 2, 2015 <br />regular meeting. <br />• Fourth Action – The BOCC receives the Planning Board recommendation and <br />makes a decision. <br />12
