Special Use Permit Findings of Fact <br /> <br />PURPOSE: To complete review of, and make a recommendation on, a Class A Special Use <br />Permit (hereafter ‘SUP’) application proposing the expansion/modification of an existing private <br />school in accordance with Section 2.7 Special Use Permits of the Unified Development <br />Ordinance (UDO). <br /> <br />As a reminder the review of this item is carried out in a quasi-judicial format. Decisions relating <br />to the approval or denial of SUP applications are based solely on the sworn testimony of all <br />parties involved with the case, both those for and against, as well as the review of competent <br />material and substantial evidence submitted during the public hearing. Hearsay, or <br />unsubstantiated opinions are not sufficient testimony. <br /> <br />CADENCE OF REVIEW: The review of a SUP is as follows: <br /> <br />• STEP ONE – NEIGHBORHOOD INFORMATION MEETING: In accordance with Section <br />27.2. of the UDO, a Neighborhood meeting was held on April 10, 2015. <br />STAFF COMMENT: The applicants, their consultants Orange county staff and one <br />adjacent property owner attended the meeting. The property owner attended to <br />learn more about the request and determine if the Master Plan included any <br />development along his common property line. Note, the request does not propose <br />any development along this portion of the school’s property. <br />• STEP TWO – PUBLIC HEARING: The first step in the review of an SUP application is <br />the holding of a public hearing to allow the applicant and other interested parties to <br />provide sworn testimony related to the proposal. <br />STAFF COMMENT: The required public hearing was held at the May 26, 2015 <br />Quarterly Public Hearing where the following testimony/evidence was entered into <br />the record: <br />25
