The Board of County Commissioners, under the authority of North Carolina General Statute, appoints the Orange 1 <br />County Planning Board (OCPB) to uphold the written land development laws of the County. The general purpose of 2 <br />OCPB is to guide and accomplish coordinated and harmonious development. OCPB shall do so in a manner which 3 <br />considers the present and future needs of its residents and business through efficient and responsive process that 4 <br />contributes to and promotes the health, safety, and welfare of the overall County. The OCPB will make every effort to 5 <br />uphold a vision of responsive governance and quality public services during our deliberations, decision, and 6 <br />recommendations. 7 <br /> 8 <br />Public Charge 9 <br />The Planning Board pledges to the residents of Orange County its respect. The Board asks its residents to conduct 10 <br />themselves in a respectful, courteous manner, both with the Board and with fellow residents. At any time, should any 11 <br />member of the Board or any resident fail to observe this public charge, the Chair will ask the offending member to leave 12 <br />the meeting until that individual regains personal control. Should decorum rail to be restored, the Chair will recess the 13 <br />meeting until such time that a genuine commitment to this public charge is observed. 14 <br /> 15 <br />AGENDA ITEM 6: CHAIR COMMENTS 16 <br /> 17 <br />Pete Hallenbeck: I would like to thank everyone for attending the Quarterly Public Hearing. 18 <br /> 19 <br /> 20 <br />AGENDA ITEM 7: MAJOR SUBDIVISION CONCEPT PLAN: To review and make a decision on a Major Subdivision 21 <br />Concept Plan (using the Flexible Design Option) application (Henderson Woods) seeking to 22 <br />subdivide a 48 acre parcel of property into 19 single family residential lots with 21.2 acres 23 <br />(44% of the site) held in common open space. The proposed subdivision is located at the 24 <br />intersection on Erwin Road and Whitefield Road in Chapel Hill Township. 25 <br /> 26 <br /> Presenter: Michael Harvey, Current Planning Supervisor 27 <br /> 28 <br />Michael Harvey: Reviewed abstract. 29 <br /> 30 <br />Craig Benedict: To conceptionalize the difference between a conventional subdivision and this flexible conservation 31 <br />cluster. The conventional would give you 19 2.5 acre lots. The flexible with give you 19 1.2 acre lots and 21 acres of 32 <br />open space. Everyone living within the project would have a share of this common open space. This is the tendency 33 <br />over the last 10 years for people to have a smaller lot to have the extra space for common open space. 34 <br /> 35 <br />Tom Heffner: My name is Tom Heffner and I am the developer of Henderson Woods. I have done a number of 36 <br />subdivisions in the area, Creekwood, Northfield, etc. I felt it was more desirable to have open space rather than larger 37 <br />lots. We came in with a plan, got comments from staff and made modifications, had the neighborhood information 38 <br />meeting, listened to their comments and input, made revisions to the proposal based on those comments. Talked to 39 <br />NCDOT and made their modifications. We believe this proposal captures most concerns and represents a reasonable 40 <br />project for the area. 41 <br /> 42 <br />Pete Hallenbeck: The existing road that comes through and Michael said you can’t get rid of the right of way but it 43 <br />would be limited to the occupants of technically the people in this subdivision couldn’t use that road to get out onto 44 <br />Erwin. 45 <br /> 46 <br />Tom Heffner: NCDOT has been explicit in saying they didn’t want that to become a secondary entrance because that 47 <br />road is so close to a signalized intersection. We would pave that road and put a gate on it so the folks who have a right 48 <br />11
