Proposed Text Amendments <br /> Ashley Moncado, Planner II 245-2589 <br /> Craig Benedict, Director 245-2575 <br /> <br /> <br />PURPOSE: To make a recommendation to the BOCC on a Planning Director initiated text <br />amendment to the Unified Development Ordinance (UDO) regarding temporary health care <br />structures. <br /> <br />BACKGROUND: On August 1, 2014, the North Carolina State Legislature adopted regulations <br />regarding the permitting of temporary health care structures in the state. These regulations allow <br />for temporary health care structures, 300 square feet or less, to be permitted as an a accessory <br />use in any single family residential zoning district on lots zoned for single family detached <br />dwellings if all the regulatory provisions outlined in Session Law 2014-94 are met. As a result, <br />staff is proposing to modify sections of the UDO to address the review and permitting of <br />temporary health care structures in order to be consistent with North Carolina General Statutes. <br /> <br />This item was presented for review and comment at the December 3, 2014 Ordinance Review <br />Committee (ORC) meeting. Agenda materials from that meeting are available at <br />http://www.co.orange.nc.us/planning/planningboard.asp. <br /> <br />The amendment was presented at the May 26, 2015 Quarterly Public Hearing. Staff addressed <br />some of the other accessory structure and housing options that are currently available in the <br />UDO in Attachment 1. Agenda materials from that meeting are available at <br />http://www.orangecountync.gov/150526QPHKC.pdf. <br /> <br />Attachment 1, the Amendment Outline Form approved by the BOCC on November 18, 2014, <br />provides additional background information on the proposal.
