BOCC Updates/Checkpoints <br />March 17, 2015 – Approved the UDO Amendment Outline Form. <br />April 1, 2015 – Planning Board Ordinance Review Committee (ORC). <br />May 26, 2015 – Quarterly Public Hearing. <br />During the public hearing the following questions/general comments were <br />made: <br />a. A planning board member indicated more effort needed to be taken <br />to ensure local property owners/developers are aware of the <br />easement and access requirements associated with the installation <br />of a BMP. <br />b. A Board member asked how maintenance requirements for an <br />installed stormwater feature would be formalized. <br />STAFF COMMENT: An operations and maintenance agreement <br />would be completed by the property owner and staff detailing the <br />perpetual maintenance responsibilities for the stormwater feature. <br />This agreement would be recorded within the Orange County <br />Registrar of Deeds Office and would run with the land meaning <br />future owners of the property would be bound to the agreement as <br />well. <br />c. A planning board member asked what would happen if a property <br />owner failed to properly maintain a BMP? <br />STAFF COMMENT: If the property owner fails to abide by the <br />agreement and maintain the system, enforcement action would be <br />taken by the County ranging from the issuance of fines, re- <br />establishment of a new BMP, or removal of the unmaintained <br />stormwater feature. This would include the removal of any <br />47
