Harvey, Planner III (919) 245-2597 <br />Craig Benedict, Director (919) 245-2592 <br /> <br />PURPOSE: To make a recommendation to the BOCC on Planning Director initiated Unified <br />Development Ordinance (UDO) text amendments requiring a neighborhood information meeting <br />(NIM) for all Special Use Permit (SUP) applications. <br /> <br />BACKGROUND: This item was presented at the September 8, 2014 Quarterly Public Hearing <br />where staff indicated the amendment was in response to concerns that a NIM was not held in <br />advance of the review of an SUP application at a public hearing. <br /> <br />The proposed amendment would require a NIM be held 45 days prior to a public hearing where <br />a SUP was scheduled for review. The applicant would be required to mail notices 14 days, and <br />post a sign on the property 10 days, prior to the meeting. <br /> <br />For additional background, including a synopsis of comments from the quarterly public hearing, <br />please refer to Attachment 1. Agenda materials from the September 8, 2014 Quarterly Public <br />Hearing can be viewed at: http://orangecountync.gov/occlerks/140908.pdf. <br /> <br />Attachment 3 contains the proposed amendments with additions shown in red text and <br />proposed deletions are shown in red strikethrough text as well as footnotes documenting the <br />rationale for the proposed modification. Modifications incorporating comments from the public <br />hearing are denoted in green text. <br />Procedural Information: In accordance with Section 2.8.8 of the Unified Development <br />Ordinance, any evidence not presented at the public hearing must be submitted in writing prior <br />to the Planning Board’s recommendation. Additional oral evidence may be considered by the <br />Planning Board only if it is for the purpose of presenting information also submitted in writing. <br />The public hearing is held open to a date certain for the purpose of the BOCC receiving the <br />Planning Board’s recommendation and any submitted written comments. <br /> <br />49
