4 <br /> <br />The Board member asked if previously denied applications could re- <br />apply based on the change in voting standards. <br />STAFF RESPONSE: Section 2.2.8 of the UDO prohibits the submittal <br />of: ‘the same or similar amendment, affecting the same property or a <br />portion of it’ for a period of 1 year from the date of denial. <br />Applicants who have had their Class B Special Use Permit requests <br />denied will have to wait the required 1 year to re-file the application, <br />which would then be subject to these revised voting standards. The <br />change in voting provisions, however, does not impact the ability of a <br />‘denied’ application to be re-filed in advance of established time limits. <br />This is somewhat of a moot point as there has not been a Class B <br />Special Use Permit application denied by the Board of Adjustment that <br />could take advantage of the new voting standard. <br />3.
