BOCC Updates/Checkpoints <br />November 5, 2013 – BOCC members approve the legal advertisement for the <br />November 25, 2013 Quarterly Public Hearing. <br />October 2, 2013 – Planning Board Ordinance Review Committee (ORC) <br />November 25, 2013 – Quarterly Public Hearing. <br />This item was reviewed at the November 25, 2013 quarterly public hearing <br />where there the following questions/comments were made: <br />1. A Board member asked staff to clarify permit thresholds for <br />telecommunication facilities. <br />STAFF COMMENT: Review and action of telecommunication facilities <br />is broken down as follows: <br />• Towers 75 feet and under – Permitted by right in every zoning <br />district and subject to administrative action (i.e. staff review) <br />with no public notice or comment required. <br />• Towers 76 to 199 feet – Permitted in every zoning district <br />subject to the review and approval of a Class B Special Use <br />Permit, acted upon by the Board of Adjustment. <br />The permit is reviewed at a previously advertised public <br />hearing with property owners within 1000 feet of the property, <br />where the facility is proposed to be located, notified of the <br />hearing via certified mail. <br />• Towers 200 feet and over – Permitted in every zoning district <br />subject to the review and approval of a Class A Special Use <br />Permit, acted upon by the Board of County Commissioners with <br />a recommendation by the Planning Board. <br />The permit is reviewed at a previously advertised public <br />hearing with property owners within 1000 feet of the property, <br />where the facility is proposed to be located, notified of the <br />hearing via certified mail. <br />2. A Board member asked staff to clarify what the concern was with <br />respect to proposed amendments to Section 2.7.14 (B) (11). <br />STAFF COMMENT: Session Law 2013-185 allows for an increase in <br />59
