Harvey, Planner III (919) 245-2597 <br />Craig Benedict, Director (919) 245-2585 <br /> <br />PURPOSE: To receive an educational presentation on the various development review <br />processes contained within the Unified Development Ordinance (UDO). <br /> <br />BACKGROUND: There are 4 review processes employed by the County, namely: <br />1. Permitted Use: A use of property reviewed/acted upon by staff with no public <br />hearing/notification required. Permitted uses can vary, based on the general use <br />zoning designation of the property, throughout the County and include residential and <br />non-residential land uses. <br />2. Special Use Permit (SUP): A use of property reviewed/acted upon by either the <br />BOCC (Class A) or the Board of Adjustment (Class B) during a previously advertised <br />public hearing where the applicant has the burden of proving, through sworn <br />testimony and the submission of ‘competent material and substantial evidence’, the <br />use complies with the provisions of the UDO and the Comprehensive Plan. <br />3. Conditional Use Permit (CU): A specific land use, not permitted under the existing <br />general use zoning designation for the subject property, reviewed/acted upon by the <br />BOCC during a previously advertised public hearing where the applicant requests a <br />rezoning of the property and the issuance of a SUP allowing for the development. <br />4. Conditional Zoning (CZ): A use of property, permitted within a previously established <br />Conditional Zoning District, reviewed/acted upon by the BOCC during a previously <br />advertised public hearing where the applicant requests a rezoning of the property, and <br />the approval of a site plan, allowing for development. <br />Please refer to Attachment 1 for additional detail on each process, what is involved, and <br />timelines for completion. Attachment 2 provides a synopsis of the development review <br />processes utilized by adjoining jurisdictions for comparison purposes. <br /> <br />There has been heightened interest in reviewing existing processes to identify opportunities for <br />streamlining the review of development projects. This is a previously identified area of interest <br />for the Planning Board and is included in the ‘Implementation Bridge’ that was written when the <br />UDO was adopted.. <br /> <br />21
