Harvey, Planner III (919) 245-2597 <br />Reynolds Ivins, Erosion Control (919) 245-2586 <br />Craig Benedict, Director (919) 245-2575 <br /> <br />PURPOSE: To make a recommendation to the BOCC on a Planning Director initiated text <br />amendment(s) to the Unified Development Ordinance (UDO) in regards to the submission of <br />formal, professionally prepared, site plans. <br /> <br />BACKGROUND: This item was presented at the February 25, 2013 Quarterly Public Hearing. As <br />indicated during the hearing these amendments seek to clarify existing language within the UDO <br />denoting when a formal site plan is required and add language requiring formal site plan submittal in <br />those instances where proposed land disturbance exceeds established stormwater management <br />thresholds. <br /> <br />Comments made during the hearing, and staff responses, are in Section C.1 (b) of Attachment 1. <br /> <br />Attachment 2 contains the proposed amendments with additions shown in red text and <br />proposed deletions are shown in red strikethrough text as well as footnotes documenting the <br />rationale for the proposed modification. <br /> <br />During the hearing staff identified 3 options with respect to addressing existing regulations <br />contained in Section 2.4.1 requiring the submittal of a professionally prepared site plan for <br />properties located within the University Lake Watershed Protection Overlay Districts. These <br />options are: <br />A. Leave section as is (i.e. only properties in the University Lake Watershed impacted) <br />and include language referencing the need for a professionally site plan when <br />stormwater land disturbance thresholds are exceeded. <br />B. Amend section as originally suggested by staff, and as currently contained in <br />Attachment 2, requiring all watershed overlay districts with a 6% impervious surface <br />limit be treated the same (i.e. require professional site plan regardless of the amount <br />of land disturbance). This option also involves including language referencing the <br />need for a site plan when stormwater land disturbance thresholds are exceeded. <br />C. Eliminate requirement all together and only require professionally prepared site <br />plans when stormwater land disturbance thresholds are exceeded. <br />51
