Attachment 4 <br />Because the UDO has been amended since these comments were made, referenced sections may be slightly off as some portions of the UDO have been <br />renumbered. <br />19 <br />Implementation Bridge - Future Phase Suggestions Planning Staff Comment <br />73.Need language that will differentiate between the different types <br />of residential zoning districts. <br />This is the purpose of the "Purpose", "Applicability" and "Dimensional <br />and Ratio Standards" sections of each of the zoning charts contained in <br />Article 3. <br />74. <br />Regarding Impervious Surface Ratios and Sliding Scales, the two <br />tables should be combined into one. Need to understand <br />ramifications of any proposed changes --Section 4.2.5. <br />COMPLETED as part of UDO adoption process. <br />75.Some home occupations are permitted but not associated <br />storage? This needs clarification. <br />76.Kennels and Riding Stables should be addressed separately. Should <br />they require a Class A or Class B Special Use Permit? <br />These two uses were uncoupled as a use category with an amendment <br />adopted on October 18, 2011. The question regarding which approval <br />process to use has not been resolved. <br />77.Clarify how open space areas of golf courses are counted towards <br />meeting ordinance requirements. <br />78. <br />Change to require a to Class "A" Special Use Permit, which would <br />require BOCC approval rather than Board of Adjustment -- Section <br />5.9.5 <br />This is in reference to Electric, Gas and Liquid Fuel Transmission Lines <br />which currently require a Class B SUP (approved by the Board of <br />Adjustment). A Class A SUP would have to be approved by the BOCC <br />(with a recommendation made by the Planning Board). The Class A <br />process is usually longer since it requires review at a quarterly public <br />hearing and then a meeting of the Planning Board whereas a public <br />hearing by the Board of Adjustment can be scheduled can occur any <br />month. The BOCC would have to make a decision on whether it would <br />like to change the approval process for this type of use froma Class B SUP <br />to a Class A SUP. Staff's opinion is, given the findings of fact are the <br />same, if an applicant demonstrates compliance with the provisions of the <br />UDO a permit must be issued, regardless of which decision-making body <br />issues the permit. <br />77
