Harvey, Planner III 245-2597 <br />Craig Benedict, Director 245-2575 <br /> <br />PURPOSE: To continue discussion on BOCC-requested input into the processes and <br />regulations for kennels. <br /> <br />BACKGROUND: At the November 7, 2012 regular meeting there was discussion over existing <br />regulations governing the development of Class I and II Kennels. Minutes from the November <br />7, 2012 meeting are contained within Attachment 1. At this meeting staff was asked to <br />investigate how surrounding counties/municipalities regulate kennels. The following table <br />summarizes our findings: <br />COUNTY/ <br />MUNICIPALITY LAND USE DESIGNATION: REVIEW PROCESS <br /> <br />DEVELOPMENT STANDARDS <br /> <br />CHATHAM <br />COUNTY <br />2 separate land use <br />categories for a ‘boarding <br />kennel’ and a ‘breeding <br />kennel’. <br /> <br />Both are reviewed through <br />the Conditional Use permit <br />process (i.e. acted upon <br />by the Chatham County <br />BOCC is a quasi-judicial <br />setting). <br /> <br />1. Allowed in residential districts <br />with a 3 acre minimum lot. <br />2. Double minimum setbacks for <br />the district where the facility <br />is located (NOTE our 150 <br />foot setback is more <br />restrictive). <br />DURHAM <br />CITY/COUNTY <br />Grouped into the ‘Veterinary <br />Clinics, Animal Hospitals, <br />and Kennels’ land use <br />category. Boarding and <br />breeding are allowed. <br />Staff review and approval 1. Allowed in residential/non- <br />residential districts. <br />2. No outdoor runs or storage <br />allowed in certain districts. <br />3. 300 foot separation between <br />outdoor areas where animals <br />are kept and adjacent <br />residential uses in a <br />residential district. Minimum <br />6 foot tall wall when adjacent <br />to a residential use in a non- <br />residential district <br />15
