Could he have horses, cattle? <br />Michael Harvey: Yes sir. The Orange County general statute does not permit Orange County Zoning to have <br />regulatory authority over farms. <br />Mark Micol: So without the special use permit he could have tractor trailers bringing cattle or picking up horses or <br />under the current zoning, right. He could have an increase in traffic in the current zoning if he had a farm. <br />Michael Harvey: If he is a bonifide farm, then yes, that could happen. <br />David Blankfard: Do you have any professional certifications, like Mr. Harvey has behind his name? <br />Certifications? <br />Gene Poveromo: No, I do not. <br />Tom Brown: Mr. Poveromo, you showed us the page 1 of the permit denial from the Health Department, you are <br />aware on page 2 that the county specifically mentioned surface drip systems as options that would be approved <br />by the state? <br />Gene Poveromo: I believe I did read the back of the letter, I can’t say I recall that. <br />Michael Harvey: Mr. Chairman, you are referring to page 120 of the abstract. <br />Gene Poveromo: I am aware there are other options that would be available. <br />Tom Brown: Any other questions. <br />Nick Herman: I think it is a question Mr. Harvey should clarify. The site plan literally had on it 16 runs. The <br />testimony is that it is the first phase but with a potential buildout to 30. Does that mean, should I be orally <br />amending the site plans to provide for that maximum? <br />Michael Harvey: At a certain level, you and your applicant have already done that indicating there is going to be a <br />30 run buildout here and I will state for the board’s edification that I use the term canine. The definition says <br />animals. If there is a perceived limit then it is staff’s use of terminology not necessarily the applicant because if <br />you refer back to attachment 1, there is no distinction on the types of animals that would be boarded or housed at <br />this facility. That is a staff distinction. <br />Nick Herman: You will get to this in a little while but your recommendations which appeared on page 140 <br />something, on roadway, what you are proposing is that the county Fire Marshal make sure those roadway <br />modifications are appropriate, in other words, make sure you had 20 feet, as a condition to this SUP. <br />Michael Harvey: That is a correct statement. <br />Nick Herman: And that even on top of that there be NCDOT review in case they need anything else.
