I prepared that letter and provided it to Mr. West. I am <br />sure it has been submitted. <br />Tom Brown: I don’t recall that. <br />Noral Stewart: It was a brief letter stating what I have stated tonight. <br />Gene Poveromo: Are there other mechanisms the applicant would contemplate in order to provide greater ___ <br />other than green vinyl and a chain link fence? <br />Noral Stewart: Are you speaking about when the dogs are outdoors? <br />Gene Poveromo: I am speaking about something to mitigate noise. <br />Noral Stewart: When the dogs are indoors in the kennel at night, he has done about as well as he could do. I <br />wouldn’t say he couldn’t do any better but he has done a very good job. I don’t think there would be any issues of <br />anybody hearing much when they are indoors at night. As I have indicated, when they are outdoors, if the dog <br />barks, you will hear it. I don’t think anyone needs me to tell you that. The levels should not exceed the ordinance <br />limits at the boundary and would be significantly less once they reach homes. As to what could be done for the <br />outdoor noise, keep the dogs indoors but if you are putting them outdoors, short of really closing them in, he has <br />done about what he can do. <br />Gene Poveromo: In your opinion, in your professional opinion, is there another type of fencing material they could <br />employ that would produce a better sound barrier and what would that be? <br />Noral Stewart: Not that would produce a situation where there is ventilation through it. You would basically have <br />to close it and seal it up as an indoor area. <br />Gene Poveromo: The answer is no. On the New Hope project, I have a copy of your letter and it states “with <br />these improvements, the sounds of all the dogs barking in the kennel would be no greater at the nearest boundary <br />than that of a single large dog over one half mile away.” Is that something … <br />Noral Stewart: We are a similar situation when the dogs are indoors. <br />Michael Harvey: I am sorry but Mr. Poveromo, could you remind the board of the context that letter was written <br />for. Were you referring to the Gene Lonsway case? <br />Gene Poveromo: Yes. Thank you very much. I am very glad to see you are working with the applicant. Part of <br />my presentation will be showing this letter and saying we would like to see something like this or this is really <br />great. <br />Tom Brown: Mr. Herman, at the end, I will give you an opportunity for a rebuttal after this testimony. <br />Gene Poveromo: I do have some questions for Chad about the solid waste facility. There was a statement that <br />there were several possible options other than the proposed. Why not explore that and come in with that <br />information at this point now? <br />Chad Abbott: That is not regulated by this board. This board does not regulate what the state allows for a permit. <br />They allow different options for different size properties. The only other option for this size property would be a <br />spray system and that would be up to the state and the applicant as far as what kind of system they would use. <br />The drip system is often the most sought after than a spray system. A spray system would fit as far as a property <br />this size is the only other option. There is surface discharge where it is discharged directly into a ditch or creek or <br />low area but that is not allowed if you had sufficient room to put drain fields.
