Mr. Lonsway readily agreed to do that and then Mr. Stewart formed some <br />numerical analysis on the design in terms of sound proofing and determined we had a very good sound dampening design. <br /> <br />Nick Herman: He is here and he will testify. Did he make certain additional recommendations to the design for acoustical <br />purposes? <br /> <br />Tony Whitaker: Yes. <br /> <br />Nick Herman: Did you, in connection with your then, construction plans, incorporate those recommendations? <br /> <br />Tony Whitaker: Yes. <br /> <br />Nick Herman: Did you incorporate all of them? <br /> <br />Tony Whitaker: Yes. <br /> <br />Nick Herman: Do you remember what they were? <br /> <br />Tony Whitaker: I remember some of them. The ones that I recall, to be sure, I mentioned this earlier, that the soffits and the <br />ridge vents are absolutely minimal in their opening size so as not to let unnecessary sound through to also line the ducts or <br />HVAC system with a material that actually reduced the sound that might travel through the HVAC system to the outside. <br />Also, the window design that I described and the heavier door design that I described were his suggestions. <br /> <br />Nick Herman: In Applicant’s Exhibits 3A, 3B and 3C. What does 3C depict? <br /> <br />Tony Whitaker: 3C labeled as A3 which is the storage building, not Phase 1 or Phase 2 but the Phase 3 storage building <br />which is essentially a large space for utilities and storage purposes. <br /> <br />Nick Herman: No dogs in the storage room? <br /> <br />Tony Whitaker: No. <br /> <br />Nick Herman: If there are no objections, I am going to introduce and make part of the record Applicant’s Exhibits 3A, 3B and <br />3C. Mr. Whitaker, did you prepare a statement for the applicant as to how the applicant believes that his application <br />complies with all the Special Use Permits requirements? <br /> <br />Tony Whitaker: Yes I did. <br /> <br />Nick Herman: Is that statement of the applicant what I have marked as Applicant’s Exhibit 4. <br /> <br />Tony Whitaker: Yes. <br /> <br />Nick Herman: And is that part of the application file? <br /> <br />Tony Whitaker: Yes it is. <br /> <br />Nick Herman: Want to ask you a few questions about that. Is there any rule of the Orange County Control Department in <br />connection with overseeing or regulating this use if approved by the board? <br /> <br />Tony Whitaker: Yes. The county does have regulations regarding Animal Control and uses the County Animal Control <br />Office to administer those. This case, it is required before a building permit is issued that the County Animal Control Office <br />review and approve the building plans to make sure they comport with their regulations and I believe there is continuing <br />oversight by the Animal Control Office having at least annual inspections that I understand are randomly carried out. <br />
