Approved 4/22/2014 <br /> <br />OC Board of Adjustment – 11/11/2013 Page 59 of 123 <br /> 1 <br />FINDINGS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT 2 <br />PERTAINING TO A REQUEST SUBMITTED BY 3 <br />AT AND T / AMERICAN TOWER 4 <br />REQUESTING A CLASS B SPECIAL USE PERMIT APPROVAL 5 <br />FOR A TELECOMMUNICATION TOWER AT 6 <br />SADDLE CLUB ROAD PINS 9826-76-9834 (location of tower) AND 7 <br />9826-68-1313 (location of access easement) 8 <br /> 9 <br />As required under Section 5.2 Table of Permitted Uses of the Orange County Unified 10 <br />Development Ordinance (UDO), a Class B Special Use Permit is required for the erection of a 11 <br />telecommunication tower, over 75 feet but under 200 feet in height, in accordance with the 12 <br />provisions of Section 2.7 of the UDO. Such permits shall comply with general and specific 13 <br />standards as set forth in Section(s) 5.3.2 and 5.10.8 of the UDO. 14 <br /> 15 <br />Section 5.3.2 (A) (2) of the UDO requires written findings certifying compliance with the 16 <br />following: 17 <br /> 18 <br />(1) The use will maintain or promote the public health, safety and general welfare, if 19 <br />located where proposed and developed and operated according to the plan as 20 <br />submitted; 21 <br /> 22 <br />(2) The use will maintain or enhance the value of contiguous property (unless the use is a 23 <br />public necessity, in which case the use need not maintain or enhance the value of 24 <br />contiguous property); and 25 <br /> 26 <br />(3) The location and character of the use, if developed according to the plan submitted, 27 <br />will be in harmony with the area in which it is to be located and the use is in 28 <br />compliance with the plan for the physical development of the County as embodied in 29 <br />these regulations or in the Comprehensive Plan, or portion thereof, adopted by the 30 <br />Board of County Commissioners; 31 <br /> 32 <br />In addition, the Board shall make findings certifying that the application is complaint with the 33 <br />following specific standards: 34 <br /> 35 <br />(5) Specific standards for the submission of Special Use Permit applications as outlined 36 <br />within Section(s) 2.2 and 2.7 of the UDO, 37 <br />(6) Specific regulations governing the development of telecommunication tower as set 38 <br />forth in Section 5.10.8 (A) through (B) of the UDO, 39 <br />(7) Section 5.3.2 (B) relating to the method and adequacy of the provision of: 40 <br />a. Sewage disposal facilities, 41 <br />b. The adequacy of police, fire, and rescue squad protection, and 42 <br />c. The adequacy of vehicular access to the site and traffic conditions around the site 43 <br />(8) The general findings outlined within Section 5.3.2 (A) (2). 44 <br /> 45 <br />Listed below are the findings of the Orange Planning staff regarding the application in question. The 46 <br />findings have been presented by Article and requirement to assist the Board of Adjustment in its 47 <br />deliberations. 48 49
