The granting of the Special Use Permit shall not prohibit or in any way prevent the property 2 <br />from being utilized to support farming operations/activities. The permit, and conditions herein, 3 <br />shall only impact the operational characteristics of the riding stable. 4 <br />2. No activity shall be allowed within the identified conservation easement currently in place on 5 <br />the western boundary of the project as detailed within Deed Book 1376 Page 236, and as 6 <br />shown on a plat recorded within Plat Book 84 Page 194, of the Orange County Registrar of 7 <br />Deeds. 8 <br />3. Those paddocks and fenced in pasture areas not meeting the 150 foot setback required to 9 <br />allow for the operation of a riding stable shall not be used as part of the overall therapeutic 10 <br />riding operation. This does not, however, prohibit horses from using these areas to feed or 11 <br />roam freely. 12 <br />4. The applicant shall address all outstanding issues associated with obtaining required 13 <br />Environmental Health permits to allow for the continued operation of the facility within 24 14 <br />months from the date of permit approval. 15 <br />5. All existing vegetation along the perimeter of the property shall be preserved it its natural 16 <br />state. 17 <br />6. No client shall be allowed to remain on the property after hours. 18 <br />7. Existing residential structure(s) can be utilized by the applicant for office and living space to 19 <br />ensure the perpetual maintenance of the facility and care of the animals housed on the 20 <br />property. 21 <br />8. The Special Use Permit will automatically expire within 12 months from the date of approval if 22 <br />the use has not commenced or construction has not commenced or proceeded unless a 23 <br />timely application for extension of this time limit is approved by the Board of Adjustment. 24 <br />9. If any condition of this Special Use Permit shall be held invalid or void, then this Special Use 25 <br />Permit shall be void in its entirety and of no effect. 26 <br /> 27 <br />MOTION to approve the Class B Special Use Permit made by Jeff Schmitt with the recommendations provided by 28 <br />staff items 1 – 9 and item 10 be approved and be an inclusion of this special use permit. Seconded by David 29 <br />Blankfard. 30 <br />VOTE: Unanimous 31 32 <br /> <br />RECOMMENDATION: <br /> <br /> <br />Staff has not received any information that would establish grounds for making a negative finding on the general <br />standards as detailed above. These standards include maintaining or promoting the public health, safety, and <br />general welfare, maintaining or enhancing the value of contiguous property, the use being in harmony with the <br />area in which it is to be located, and the use being in compliance with the general plan for the physical <br />development of the County. <br /> <br />Staff has reviewed the application, the site plan, and all supporting documentation and has found that the <br />applicant complies with the specific standards and required regulations as outlined within the UDO <br /> <br />Provided the Board of Adjustment finds in the af firmative on the specific and general standards, the Board could <br />make a positive finding on this application. In the event that the Board makes a recommendation to issue the <br />permit, staff recommends the attachment of the following conditions:
