Health department is no issue with the permit being issued as long as the applicant makes good 8 <br />on their continued work to address the concerns you have articulated. I am a resident of Orange County for about 30 years or 19 <br />more. I would like to use this as an aid. I own 185 acres including along this property line. I think their operation 20 <br />which I have observed for the last several months is an excellent operation and they have never caused any 21 <br />noise or any reason for complaint and I highly recommend the approval of the application. The Cases’ (the 22 <br />current owner of the Nicks Road property) will continue (to live) on a 20 acre parcel if they don’t have access they 23 <br />will be land-locking themselves if they don’t obtain some type of an access easement. 24 <br /> 25 <br />Michael Harvey: Mr. Zaragoza brought this to my attention and a week ago, we brought it to the attention of Ms. 26 <br />Steffan. The applicant is willing to grant some form of easement so I will be recommending an additional 27 <br />condition of the granting of this SUP if this board chooses that an appropriate easement location shall be 28 <br />referenced on the site plan and Mr. Zaragoza and I have been neighbors and friends longer than we want to think 29 <br />about going back to my freshman year of high school. 30 <br /> 31 <br />Mark Micol: Is he the largest property owner? 32 <br /> 33 <br />Jay Zaragoza: I probably am the largest property owner. There is a 10 acre tract here owned by a bank due to a 34 <br />foreclosure and the property next to it is being sold. 35 <br /> 36 <br />Michael Harvey: Reviewed staff’s recommendations. 37 <br /> 38 <br />Michael Harvey: We have recommended approval subject to these nine conditions with the addition of Condition 39 <br />10 indicating that an easement shall be provided allowing access to the Cases’ for their adjacent property. 40 <br /> 41 <br />MOTION made by David Blankfard to close the public hearing and go into closed session.
