APPROVED 11/11/2013 <br />OC Board of Adjustment – 9/10/2013 Page 30 of 38 <br /> 1 <br />Geof Gledhill: Mr. Harvey, will you identify yourself and state your position with Orange County 2 <br />and your qualifications for that position. 3 <br /> 4 <br />Michael Harvey: I am the Current Planning Supervisor for Orange County Planning. I was 5 <br />brought on board in 2005 as the Chief Zoning Enforcement Officer. I was promoted to the Senior 6 <br />Level Planning position in 2010 to assume the duties of the current planning supervisor. I have 7 <br />Bachelor of Science degrees from East Carolina University in both political science and urban 8 <br />planning. I have been a practicing planner for 18 years, a certified planner for the American 9 <br />Planning Association, I am ASC certified. I am also a certified zoning enforcement officer for the 10 <br />Institute of Government and a certified flood plain manager through FEMA. 11 <br /> 12 <br />Geof Gledhill: I would tender Mr. Harvey as a professional planner certified in all the things he is 13 <br />certified in essentially as an expert witness. In the interest of time, I am going to lead Mr. Harvey, 14 <br />meaning I will flesh out the questions so he can answer as many in a yes or no format as possible 15 <br />to save time. 16 <br /> 17 <br />Geof Gledhill: Through the recorded SUP including those documents incorporated to it by 18 <br />reference together with recorded plats memorialize this Scotswood Planned Development special 19 <br />use? 20 <br /> 21 <br />Michael Harvey: Yes. 22 <br /> 23 <br />Geof Gledhill: Is Attachment C of the record, the recorded SUP of the project including the 24 <br />documents incorporated by reference? 25 <br /> 26 <br />Michael Harvey: Yes. 27 <br /> 28 <br />Geof Gledhill: Does Attachment D of the record include all recorded plats constituting approved 29 <br />site plans for this project? 30 <br /> 31 <br />Michael Harvey: Yes sir. 32 <br /> 33 <br />Geof Gledhill: Have you analyzed the recreation component shown on the recorded plats and 34 <br />have you determined those components platted as developed conform to Condition 27 of the 35 <br />SUP related to recreation areas and facilities? 36 <br /> 37 <br />Michael Harvey: Yes sir, they do. 38 <br /> 39 <br />Geof Gledhill: Have you prepared a chart for the way Scotswood as platted and as developed, 40 <br />Churton Grove, Braddock Park, the commercial area satisfies the complained about recreation 41 <br />recommendations contained in the SUP? 42 <br /> 43 <br />Michael Harvey: Yes sir. 44 <br /> 45 <br />Geof Gledhill: Would you refer to that chart which is already in evidence. 46 <br /> 47 <br />Michael Harvey: Attachment B. Staff essentially took Mr. Buck’s argument and indicated the 48 <br />active recreation area and I am quoting from my response includes all necessary lot areas 49 <br />supporting the use of said amenities. This includes parking, property located in required 50 <br />setbacks, undeveloped property available for recreational use, required open space for recreation 51
