I would like to submit 7 into evidence, I only have one copy, there is a picture of it in Exhibit 3 but I will relinquish that 8 copy. The picture I am showing here is a digitized area view created by the county engineer’s 9 office provided to me courtesy of the current planning supervisor serving 2007 or 2008. This is 10 what the county has used in order to claim how much active recreation space is used on the 11 recreation parcel on the Phase II plat. If I may, the Phase II plat has this large 16 acre recreation 12 parcel and the plat actually has the words 16 acres of recreation but it further clarifies there is 9 13 acres of passive recreation and the plat says there is 7.06 acres of active recreation. The letter I 14 just provided to you from the planning director says there is actually .4 acres of active recreation 15 on that location so the planning director is saying despite what is on the plat, there is .4 acres of 16 active recreation. The picture I am showing you here from the zoning officer says there is 3.77 17 acres of active recreation. I would like to present this into evidence. 18 19 Debra Graham: Michael has gone to make copies of that. I am labeling the letter Exhibit 7 and 20 that will be Exhibit 8. 21 22 Michael Buck: I guess I should submit this so you are able to see what is actually there. This is a 23 satellite view of the Churton Grove single family recreation parcel showing there are amenities 24 and a parking lot on what is in the general shape of the planner’s digitized view so I would like to 25 submit slide 51 into evidence. 26 27 Karen Barrows: What is actually on this? 28 29 Michael Buck: We have a parking lot, clubhouse, swimming pool, one tennis court, basketball 30 court and some gravel paths; small children’s play area and a gazebo. In Phase II, back to the 31 Plano meter tool, I highlighted this area which is about 1.346 acres that is within the area of the 32 3.77 the planning supervisor is claiming. I don’t really care to get down to 100ths or 10ths of an 33 acre but I am happy to stick to rough numbers. There are 1.3 acres in this vicinity. There is a 34 slope and I am not claiming to be an engineer but this distance is about 20 feet and drops off 35 over 10 feet and this is the location on the parcel where the picture was taken. 36 37 Geof Gledhill: Objection. 38 39 Larry Wright: What grounds? 40 41 Geof Gledhill: The grounds that I don’t know what he just said constitute a slope of 15%. 42 43 Larry Wright: He is under oath I think … I am going to accept what he has to say. 44 45 Michael Buck: If I better understood the sequence I would have left off some of these things. 46 This is a slightly different location and so in terms of keeping track of these as evidence, I want to 47 make sure these are being included.
