APPROVED 11/11/2013 <br />OC Board of Adjustment – 9/10/2013 Page 21 of 38 <br />will stop the presentation and we can pick up here when I get to my summary and argumentation. 1 <br /> With the exception of the words, I would like to submit slide 42 which is a picture of the parcel 2 <br />showing on the plat for Phase IV that is designated active resignation. This is in Attachment 4. 3 <br />Page 42 has two pictures on it. Actually, I am going to forward through because I just realized 4 <br />there are some other key pieces I need to show as well. I would like to try to offer evidence is 5 <br />acreage calculations that I have used an online tool to overlay on a Google map to show how 6 <br />much of a parcel, what its size is. 7 <br /> 8 <br />Larry Wright: What is the online tool? 9 <br /> 10 <br />Michael Buck: It is referenced on page 41 called freemaptools.com and it is a planimeter tool and 11 <br />you can key in the points of a square or a polygon and it will state for the area you have 12 <br />highlighted, here is the acreage for that location. 13 <br /> 14 <br />David Blankfard: Are you a registered surveyor? 15 <br /> 16 <br />Michael Buck: I am not. 17 <br /> 18 <br />Geof Gledhill: I don’t happen to have an objection to this slide because it agrees with something 19 <br />else I have but I am going to object to Mr. Buck introducing these Google map calculations, I 20 <br />don’t have a clue whether they are accurate or not. 21 <br /> 22 <br />Michael Buck: With respect, I want to attempt to show there is a reasonable accuracy here. I 23 <br />don’t wish to claim these are 100% accurate but I will attempt to do a control which will show you 24 <br />what area is being shown by this matches plats because the county has not provided surveys that 25 <br />indicate the acreage area of that have slopes, utility easements, other areas that ordinance does 26 <br />not allow. 27 <br /> 28 <br />Geof Gledhill: And I object to each one of those because I don’t think it pertains to this appeal. 29 <br /> 30 <br />Larry Wright: Sustained. 31 <br /> 32 <br />Michael Buck: I would say that is argumentative based on the dates that have been shown to be 33 <br />relevant dates that are a conclusion that has not been proven in this case yet. 34 <br /> 35 <br />David Rooks: It’s your call Mr. Chairman. It seems we have wandered a bit from what the 36 <br />charge is tonight. 37 <br /> 38 <br />Larry Wright: I am going to have to sustain this. 39 <br /> 40 <br />Geof Gledhill: Just his last comments. 41 <br /> 42 <br />Jeff Schmitt: I think it is fair for him to make a representation which may or may not be from a 43 <br />surveyors’ perspective aromatically absolute but characterize it as being somewhat generally 44 <br />close or an estimate. 45 <br /> 46 <br />Larry Wright: I want to know where this evidence and how it relates to the overall, where are you 47 <br />going with this so I can rule on this. 48 <br /> 49 <br />Michael Buck: The zoning officer has made claims that acreage shown on plats is eligible for 50 <br />active recreation purposes.
