One of the developers, Churton Grove, LLC, which 10 <br />was operating in the early phases of the development sold their rights to develop Phase 3 and 4 11 <br />and in selling their rights, it is unclear to me so I will not testify to what arrangements they made 12 <br />with regard to developing the bridges and other amenities but there was change in the primary 13 <br />developer. 14 <br /> 15 <br />Larry Wright: Proceed please. 16 <br /> 17 <br />Michael Buck: What I am showing here is a Google Earth…. 18 <br /> 19 <br />Geof Gledhill: I am going to object to this slide coming into evidence because of what is clearly 20 <br />an argument. I put 27 <br />the river or the creek; I am going to take that away because the map will get busy enough. Here 28 <br />are the trails that are in existence and I painted them with different colors and line patterns to 29 <br />show they are not connected but for the existence of the one bridge that has been built. Notice 30 <br />there is no connection at this point and no connection at this point or this point. As the special 31 <br />use permit said… 32 <br /> 33 <br />Geof Gledhill: I object to that conclusion. 34 <br /> 35 <br />Larry Wright: On the basis of? 36 <br /> 37 <br />Geof Gledhill: I don’t think it is true, number one. I don’t think that shows that they are not 38 <br />connected. 39 <br /> 40 <br />Michael Buck: Fair enough. Let me add additional context. All the painted areas are five foot 41 <br />wide asphalt paths and there is no five foot wide asphalt path at that location or that location. 42 <br /> 43 <br />Karen Barrows: There is one to the south, the yellow connects on. 44 <br /> 45 <br />Michael Buck: We have the creek that goes through the center so this is the asphalt path that 46 <br />goes under the pedestrian bridge, that is true. But for the existence of this bridge, there is no 47 <br />path connection from here to this path in the recreation area and this path in Phase I to the 48 <br />recreation area. 49 <br /> 50
