Approved 9/10/2013 <br /> <br />OC Board of Adjustment – 7/8/2013 Page 39 of 82 <br /> <br />SECTION 5.10.8 (B) – GENERAL SUBMITTAL REQUIREMENTS – SPECIAL USE PERMITS – CONTINUED ("Yes" 1 <br />indicates compliance; "No" indicates non-compliance) 2 <br />Ordinance Requirements <br />PLANNING STAFF <br />RECOMMENDED <br />FINDINGS <br />EVIDENCE SUBMITTED <br />TO SUPPORT FINDINGS <br />BOA <br /> FINDINGS <br />5.8.10 (B) (2) Balloon Test <br /> <br />(a) The applicant shall, at least <br />six weeks prior to a Class B <br />Special Use Permit public <br />hearing and at least 11 weeks <br />prior to a Class A Special Use <br />Permit public hearing, conduct a <br />balloon test whereby the <br />applicant shall arrange to fly, or <br />raise upon a temporary mast, a <br />minimum of 10’3” in length, <br />brightly colored red or orange <br />balloon at the maximum height <br />of the proposed new wireless <br />support structure. <br /> <br />(b) The balloon test shall be <br />flown for at least four <br />consecutive daylight hours <br />starting sometime between <br />10:00 A.M. and 2:00 P.M. on <br />the dates chosen. <br /> <br />(c) A notice of the dates <br />(including a second date in <br />case of poor visibility, weather <br />or atmospheric conditions on <br />the initial date), times, and <br />location of the balloon test shall <br />be mailed, by certified mail, <br />return receipt requested, by the <br />applicant, to all persons owning <br />property within 1,000 feet of the <br />subject parcel no less <br /> <br /> X Yes ___No Tab(s) 3, 7, 8, 9, 10, 11, and <br />12 of the application booklet <br />contains the required <br />information. <br /> <br />The balloon test was <br />completed on April 20, 2013 – <br />7 weeks prior to the June 10, <br />2013 BOA public hearing. <br />This date did not fall on a <br />holiday and is consistent with <br />the requirement of Section <br />5.8.10 (B) (2) (d) of the UDO <br />as detailed herein. <br /> <br /> <br />Tab 7 contains pictures of the <br />balloon test, which was held <br />from 10:00 a.m. until 2:00 p.m. <br />on April 20, 2013. <br /> <br />Notices of the balloon test <br />were sent to property owners <br />within 1000 feet, of the subject <br />property, via certified mail on <br />April 3, 2013, 17 days prior to <br />the scheduled balloon test. <br /> <br />The list of property owners <br />within 1000 feet utilized by the <br />applicant was generated <br />utilizing data maintained by <br />Orange County Land Records <br />as required by the UDO. <br /> <br /> <br /> <br /> _x__Yes ____No <br />3
