Approved 9/10/2013 <br /> <br />OC Board of Adjustment – 7/8/2013 Page 24 of 82 <br /> <br /> 1 <br /> 2 <br /> 3 FINDINGS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT 4 <br />PERTAINING TO A REQUEST SUBMITTED BY 5 <br />AT AND T / AMERICAN TOWER 6 <br />REQUESTING A CLASS B SPECIAL USE PERMIT APPROVAL 7 <br />FOR A TELECOMMUNICATION TOWER AT 8 <br />1426 OLD GREENSBORO ROAD – PIN 9768-22-3878 9 <br /> 10 <br />As required under Section 5.2 Table of Permitted Uses of the Orange County Unified Development Ordinance 11 <br />(UDO), a Class B Special Use Permit is required for the erection of a telecommunication tower, over 75 feet but 12 <br />under 200 feet in height, in accordance with the provisions of Section 2.7 of the UDO. Such permits shall comply 13 <br />with general and specific standards as set forth in Section(s) 5.3.2 and 5.10.8 of the UDO. 14 <br /> 15 Section 5.3.2 (A) (2) of the UDO requires written findings certifying compliance with the following: 16 <br /> 17 <br />(1) The use will maintain or promote the public health, safety and general welfare, if located where proposed 18 <br />and developed and operated according to the plan as submitted; 19 <br /> 20 <br />(2) The use will maintain or enhance the value of contiguous property (unless the use is a public necessity, in 21 <br />which case the use need not maintain or enhance the value of contiguous property); and 22 <br /> 23 <br />(3) The location and character of the use, if developed according to the plan submitted, will be in harmony 24 <br />with the area in which it is to be located and the use is in compliance with the plan for the physical 25 <br />development of the County as embodied in these regulations or in the Comprehensive Plan, or portion 26 <br />thereof, adopted by the Board of County Commissioners; 27 <br /> 28 In addition, the Board shall make findings certifying that the application is complaint with the following specific 29 <br />standards: 30 <br /> 31 <br />(1) Specific standards for the submission of Special Use Permit applications as outlined within Section(s) 2.2 32 <br />and 2.7 of the UDO, 33 <br />(2) Specific regulations governing the development of telecommunication tower as set forth in Section 5.10.8 34 <br />(A) through (B) of the UDO, 35 <br />(3) Section 5.3.2 (B) relating to the method and adequacy of the provision of: 36 <br />a. Sewage disposal facilities, 37 <br />b. The adequacy of police, fire, and rescue squad protection, and 38 <br />c. The adequacy of vehicular access to the site and traffic conditions around the site 39 <br />(4) The general findings outlined within Section 5.3.2 (A) (2). 40 <br /> 41 <br />Listed below are the findings of the Orange Planning staff regarding the application in question?
