Approved 7/8/2013 <br />OC Board of Adjustment – 6/10/2013 Page 32 of 92 <br />SECTION 5.10.8 (B) – GENERAL SUBMITTAL REQUIREMENTS – SPECIAL USE PERMITS – 1 <br />CONTINUED ("Yes" indicates compliance; "No" indicates non-compliance) 2 <br />Ordinance <br />Requirements <br />PLANNING <br />STAFF <br />RECOMMENDED <br />FINDINGS <br />EVIDENCE SUBMITTED <br />TO SUPPORT <br />FINDINGS <br />BOA <br /> FINDINGS <br />5.8.10 (B) (2) Balloon <br />Test <br /> <br />(a) The applicant shall, at <br />least six weeks prior to a <br />Class B Special Use <br />Permit public hearing and <br />at least 11 weeks prior to <br />a Class A Special Use <br />Permit public hearing, <br />conduct a balloon test <br />whereby the applicant <br />shall arrange to fly, or <br />raise upon a temporary <br />mast, a minimum of 10’3” <br />in length, brightly colored <br />red or orange balloon at <br />the maximum height of <br />the proposed new <br />wireless support structure. <br /> <br />(b) The balloon test shall <br />be flown for at least four <br />consecutive daylight <br />hours starting sometime <br />between 10:00 A.M. and <br />2:00 P.M. on the dates <br />chosen. <br /> <br />(c) A notice of the dates <br />(including a second date <br />in case of poor visibility, <br />weather or atmospheric <br />conditions on the initial <br />date), times, and location <br />of the balloon test shall be <br />mailed, by certified mail, <br />return receipt requested, <br />by the applicant, to all <br />persons owning property <br />within 1,000 feet of the <br />subject parcel no less <br /> <br /> X Yes ___No Tab(s) 3, 7, 8, 9, 10, 11, <br />and 12 of the application <br />booklet contains the <br />required information. <br /> <br />The balloon test was <br />completed on April 13, <br />2013 – 8 weeks prior to <br />the June 10, 2013 BOA <br />public hearing. This date <br />did not fall on a holiday <br />and is consistent with the <br />requirement of Section <br />5.8.10 (B) (2) (d) of the <br />UDO as detailed herein. <br /> <br /> <br />Tab 7 contains pictures <br />of the balloon test, which <br />was held from 10:00 a.m. <br />until 2:00 p.m. on April <br />13, 2013. <br /> <br />Notices of the balloon <br />test were sent to <br />property owners within <br />1000 feet, of the subject <br />property, via certified <br />mail on March 25, 2013, <br />20 days prior to the <br />scheduled balloon test. <br /> <br />The list of property <br />owners within 1000 feet <br />utilized by the applicant <br />was generated utilizing <br />data maintained by <br />Orange County Land <br />Records as required by <br />the UDO. <br /> <br /> <br /> <br /> _x_Yes ____No <br />3
