Approved 7/8/2013 <br />OC Board of Adjustment – 6/10/2013 Page 15 of 92 <br />project narrative, tab 39, Mr. Smith’s Impact Analysis, tab 6, the site plan indicating the project will 1 <br />comply with the code and promote the public’s health safety and general welfare. You have tabs 14, 2 <br />16 and now on page 92, 14, 16, 17, 18, 19, 20, 21, 22, and 30 are tabs having information 3 <br />demonstrating the need for the tower and the development of the tower will be done with respect to 4 <br />guarantee the public’s general health, safety and welfare. Page 93, complies with Section 5.3.2 (A) 5 <br />(2) (b) which is the use will maintain or enhance the value of contiguous property. You have had 6 <br />testimony this evening from Mr. Smith and the application packet specifically tabs 3, 39 and 6 provide 7 <br />other documentation and information necessary to demonstrate compliance. On page 94, we have 8 <br />requirements of Section 5.3.2 (A) (2) (c) which is the location and character of the use if developed in 9 <br />accordance to the plan submitted will be in harmony with the area in which is it to be located. As staff 10 <br />indicates in our abstract several provisions of the 2030 Comprehensive Plan supporting the submittal 11 <br />of telecommunication applications and the approval of telecommunication applications. We also 12 <br />stipulate that tabs 3, 39 and 6 provide information demonstrating compliance with this standard. We 13 <br />have heard no comments prior to this hearing indicating the project should not be approved so on 14 <br />page 95 and 96, if the board does see fit to issue the permit, we recommend the imposition of 19 15 <br />conditions which are spelled out herein. I will add, and the applicant can confirm, that they have 16 <br />reviewed these conditions and have no issues with them being attached. 17 <br /> 18 <br />Larry Wright: Are there any questions for Mr. Harvey? 19 <br /> 20 <br />Karen Barrows: On page 85, 5.10.8 (B), Bond Security, is that in addition to the liability? 21 <br /> 22 <br />Michael Harvey: Yes, and on page 86, liability insurance they have to cover as well. If there are no 23 <br />more questions, that concludes staff’s presentation. 24 <br /> 25 <br />Karen Kemerait: I want to confirm that we had reviewed the conditions. 26 <br /> 27 <br />Larry Wright: Any statement from the applicant? 28 <br /> 29 <br />Karen Kemerait: Nothing in addition to what I have already stated. 30 <br /> 31 <br />Larry Wright: We have gathered the evidence and now it’s time to close the hearing. Are there any 32 <br />general comments from the Board right now? 33 <br /> 34 <br />Samantha Cabe: This is my first time here and I am not voting as an alternate but does the attorney 35 <br />reiterate the charge of what we must do if we find this? 36 <br /> 37 <br />Larry Wright: It depends on the case and usually what we have is our charge is what we have to go 38 <br />through and then we go through the findings and right now most of this case is in the findings so we 39 <br />will move right to the findings. We don’t have to make any formal recommendations… on this 40 <br />application we can move right to the findings. Who are the five voting members and do you 50 <br />allow alternates in the deliberations. I reiterated before that it is gray but for deliberations there is a 51 <br />little more weight not to have alternates. 52 <br /> 53
