The applicant shall apply for, and receive, all required State and Federal permits 1 <br />authorizing the commencement of land disturbing activities. The applicant shall provide 2 <br />copies of said permits/authorizations to the County. This shall include any NC 3 <br />Department of Transportation encroachment agreements required for the project. 4 <br />4. The applicant shall provide copies of all executed easement agreement(s) for all 5 <br />impacted properties. 6 <br />5. The County Attorney’s office shall review all easement agreements to ensure appropriate 7 <br />language is present allowing for emergency vehicle access. 8 <br />6. The applicant shall coordinate, with the Orange County Fire Marshal, the scheduling of a 9 <br />meeting to review/develop an emergency action plan in the event of a gas line 10 <br />leak/rupture. 11 <br />7. At the commencement of earth disturbing activity, the applicant shall coordinate with the 12 <br />Planning Department and DEAPR staff to ensure the preservation and protection of 13 <br />identified historic/cultural resources in the area of the pipeline project. 14 <br />8. The Special Use Permit will automatically expire within 12 months from the date of 15 <br />approval if the use has not commenced or construction has not commenced or 16 <br />proceeded unless a timely application for extension of this time limit is approved by the 17 <br />Board of Adjustment. 18 <br />9. If any condition of this Special Use Permit shall be held invalid or void, then this Special 19 <br />Use Permit shall be void in its entirety and of no effect. 20 <br /> 21 <br />MOTION: by Jeff Schmitt that in addition to the requirements of Section 5.3.2.a. subsection 2 it is the 22 <br />recommendation of the Board that items number 1 through 9 as recommended by staff be added to the 23 <br />SUP for compliance by the applicant.
