Next speaker please. 22 <br /> 23 <br />Michael Harvey: Jason Thomas. 24 <br /> 25 <br />Jason Thomas: Good evening, my name is Jason Thomas having been sworn. I’m a licensed attorney 26 <br />in the State of North Carolina. I am an employee of the Department of Justice so I think it’s important to 27 <br />note that I am here solely in my personal capacity and I’m not here as a representative of any kind. I live 28 <br />at 8107 Old NC 86, my driveway happens to be under or over I guess, the existing pipeline and adjacent 29 <br />to, I don’t know what particular kind of station it is that they are erecting but they are erecting a station on 30 <br />Old NC 86 and that’s adjacent to my driveway. So my comments touch upon matters within your 31 <br />jurisdiction that are concerns raised by my immediate experience with their construction activities on and 32 <br />near my property. The two areas within your jurisdiction I think are important have to do with public 33 <br />safety and with maintaining the character of the environment and the nature of the development in the 34 <br />area in which they are working. I observed, as it happens the end of my driveway is the bus stop for the 35 <br />public schools and the PSNC folks who are doing the work there seemed entirely uninformed of that fact 36 <br />and made no plans for moving the bus stop to a safer place so in effect, the school bus was stopping to 37 <br />pick up my children and other children in what seemed to me more akin to an industrial construction zone 38 <br />than a residential driveway. I was disappointed that PSNC had not foreseen that and taken steps to 39 <br />move, even temporarily, the bus stop to a safer place. It seems to me that you have the power by a 40 <br />condition of this permit to require that they make such planning and I would encourage you please to 41 <br />consider that. I have observed from their work area substantial amounts of sediment flowing during 42 <br />stormwater events into the ditches along the side of Old NC 86 and from there into the perennial stream 43 <br />that flows underneath Old NC 86 and eastward toward Chapel Hill. I see erosion control devices in place 44 <br />but they are plainly inadequate for the job so I would encourage by virtue of another condition of the 45 <br />permit that some kind of accelerated or perhaps slightly aggressive inspections be taken place to make 46 <br />sure that their sedimentation control devices don’t merely comply with their plans but actually meet state 47 <br />standards. My third concern has more to do with the above ground structures than. 48 <br /> 49 <br />Larry Wright: You have to be sworn in, you’re giving testimony. 50 <br /> 51 <br />Jason Thomas: I’ll be happy to swear. 52 <br /> 53 <br />Larry Wright: Ok, just put your hand on towards the bible.
