APPROVED 10/13/2014
OC Board of Adjustment – 8/27/2014 Page 23 of 64

Joseph Zaragoza: If PSNC doesn’t do this, they want to avoid going through this pond a second time 1
and they want to avoid filling it in but there is no reason to make my life miserable by taking the easy way 2
by avoiding that pond. Just want to check my notes. There were several questions and answers. I think 3
there was a question about access. PSNC wants to utilize my road. Now the easement document in 4
1952 says flat out, you don’t have the right to use anything but your easement to get to your easement. 5
But they want to use the power of imminent domain to basically say, we don’t care what your 52 6
easement says, we are coming down here. And given the documents I received, I decided they don’t 7
want to pay me a nickel for it. In fact, the first, I know I shouldn’t talk about numbers but I think it is 8
important. 9
Matt Rhoads: I am going to object. 10
Larry Wright: I’ll give you chance, is that okay. 11
Joseph Zaragoza: The first amount of money the offered me was more than the second amount of 12
money they offered me. They want more and they want to pay less. You want to sue me, go right 13
ahead. 14
Larry Wright: You are talking to the Board please. 15
Joseph Zaragoza: He may want to keep quiet too. 16
Larry Wright: You are talking to the Board. 17
Joseph Zaragoza: I believe there was a special use permit requiring this vegetation. This easement, in 18
orange, is the new PSNC easement. I like these trees, they provide me the only measure of screen 19
around this valve station. They need to take these easement and move it ever so slightly but the plans 20
you saw show these trees being eliminated. They need to move it over here and it wouldn’t affect 21
anything as long as they put that pipeline deep into the ground. Mr. Rhoads, no I’m sorry, Mr. Priester 22
said they were working on the easement issue. That is what I was trying to address. By working out, 23
they mean suing me. I do have an attorney representing me on those matters so we will find out what 24
happens. There is one other matter that involves when I was building this road, PSNC never took the 25
steps to eliminate that pond and if PSNC doesn’t lower the pipe to where I can build a DOT standard 26
road it’s because they were too, well.... If PSNC doesn’t do this, you know, they want to avoid this going 27
through this pond a second time. They want to avoid filling it in but there’s no reason to make my life 28
miserable by making themselves, taking the easy way by avoiding that pond. I just want to check my 29
notes. There are several questions and answers. I think there was a question about access. PSNC 30
wants to utilize my road now the easement document in 1952 says flat out you don’t have right to use 31
anything but your easement to get to your easement. But they want to use the power of eminent domain 32
to basically say we don’t care what your ’52 easement says, we are coming down here. And from the 33
documents I received they’ve decided they don’t want to pay me a nickel for it. In fact, the first, I know I 34
shouldn’t talk about numbers but I think it’s important. As I said I believe there was a special use permit 35
requiring this vegetation. Mr. Rhoads said that, no I’m sorry, Mr. Priester said that they were working out 36
the easement issue. Well, that’s what I was trying to address but working it out they mean screwing. I 37
do have an attorney representing me on those matters, so we’ll find out what happens. There is one 38
other matter, it involves when I was building this road, this farm path, I uncovered part of the old 10 inch 39
pipeline. I don’t submit it to the record and I’ll tell you why. I like this pipe and I don’t know if you want to 40
keep it but it is here so who wants to lift it up and show what a 1952 10 inch steel pipeline, that’s been 41
sitting in the acidic soils in North Carolina, looks like, here’s your chance. You’ll notice the steel is 42
corroded. The protective coating is worn. Now I’m not saying that every pipeline on this length every 43
section looks anything like it but it will give you one indication that there’s any well slicing of that black 44
protective covering this stuff you can see what happens. It might take 60 years for that to happen but 45
this thing is indicative of what could happen if you put 800 lbs. in there and its and I’m not a pipeline 46
expert but I thought it was interesting. And I didn’t dig it out of the PSNC easement area. It was sort of 47
off to the side. I think that concludes my formal presentation. 48
