The height of the tower shall not exceed a height of 199 feet above pre-construction grade as 2 <br />detailed within the approved application package as reviewed and acted upon by the Board of 3 <br />Adjustment at their April 22, 2014 meeting. 4 <br />2. Existing vegetation, as detailed on the approved site plan reviewed and acted upon by the Board 5 <br />of Adjustment at their April 22, 2014 meeting, shall be maintained as indicated. 6 <br />3. The facility and its equipment shall comply with all federal, state and local emission requirements. 7 <br />4. The electro-magnetic radiation levels shall be maintained compliance with all federal, state and 8 <br />local requirements, including the requirements of the Federal Communications Commission 9 <br />regarding emission of electromagnetic radiation. Within 30 days of installation of equipment on 10 <br />the tower, and within 30 days of the installation of any additional equipment in the future, the 11 <br />tower owner shall provide documentation of emission levels in relation to FCC standards to the 12 <br />County for review. In addition, the tower owner must provide documentation of emission levels 13 <br />within five working days if so requested by Orange County. Orange County may make such 14 <br />requests at any time, not to exceed 2 times per year. 15 <br />5. Two ten pound 2-A:20-B:C dry chemical portable fire extinguishers shall be installed at the site at 16 <br />a conspicuous location for use during an emergency event. 17 <br />6. As required within Section 5.10.8 (A) (1) (g) of the UDO, the applicant shall be required to 18 <br />provide a final copy of the installed foundation design including a geotechnical sub-surface soils 19 <br />investigation, evaluation report, and foundation recommendation for the proposed wireless 20 <br />support structure prior to the commencement of land disturbing activities associated with the 21 <br />construction of the telecommunication facilities. 22 <br />7. The applicant shall obtain a driveway permit from the NC Department of Transportation 23 <br />approving the driveway access for the project off of Saddle Club Road. 24 <br />8. Final assignment of a street address shall be completed by Orange County Land Records prior 25 <br />to the issuance of any permit authorizing land disturbing activity on the property. 26 <br />9. The applicant shall obtain all necessary development permits from the County prior to the 27 <br />initiation of and land disturbing activity associated with the construction of the telecommunication 28 <br />facilities including, but not limited to: Building Permit, Erosion Control/Stormwater Management 29 <br />Permit, and Zoning Compliance Permit. 30 <br />10. Any proposed co-location of antenna on this tower shall be reviewed, acted upon, and installed in 31 <br />accordance with the provisions of the UDO. 32 <br /> 33 <br /> <br />RECOMMENDATION: <br /> <br /> <br />Staff has not received any information that would establish grounds for making a negative finding on the <br />general standards as detailed above. These standards include maintaining or promoting the public health, <br />safety, and general welfare, maintaining or enhancing the value of contiguous property, the use being in <br />harmony with the area in which it is to be located, and the use being in compliance with the general plan for the <br />physical development of the County. <br /> <br />Staff has reviewed the application, the site plan, and all supporting documentation and has found that the <br />applicant complies with the specific standards and required regulations as outlined within the UDO <br /> <br />Provided the Board of Adjustment finds in the affirmative on the specific and general standards, the Board <br />could make a positive finding on this application. In the event that the Board makes a recommendation to <br />issue the permit, staff recommends the attachment of the following conditions:
