That's the whole point. The purpose for the question is to illicit what the <br />12 options are for building this single cell tower, 199 -foot cell tower, on this location. Is there an <br />13 alternative that would solve and address the problem along Mt. Carmel Road? And they know <br />14 there is and they know what that alternative is but they're unwilling to testify. <br />15 <br />16 Samantha Cabe: Mr. Price, this is not the time for an argument. I understand the point you're <br />17 making, I think we all understand your point. We have a set of questions to answer per our UDO. <br />18 And we understand your questioning and you'll be given a chance to argue at the end if you're <br />19 finished with your cross examination. I'm just trying to keep this on track because again we have <br />20 an hour left and I think there's still a lot of people here that want to be heard. <br />21 <br />22 John Price: Yes. Maybe staff can assist on this. But it's my understanding that the burden of proof <br />23 is upon Towercom. We've established that it meets all the requirements, and it has met all the <br />24 requirements of the ordinance, including consideration of alternatives. <br />25 <br />26 Samantha Cabe: And we're going to discuss all of that in our deliberation. But we're ruling on <br />27 summary judgement here, we have to collect all the information and make our decision at the end <br />28 and we get your point.
